RESOLUTION 69-148 DELETING CONDITION NO. 2 IMPOSED <br />BY THE PLANNING COMMISSION IN GRANTING A VARIANCE <br />ON VARIANCE APPLICATION 69-56 FILED BY ROHRS <br />INVESTMENT COMPANY <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission has granted a variance on variance Application 69-56 <br />filed by ROHRS INVESTMENT COMPANY to modify plans and conditions <br />of an approved shopping center by permitting a restaurant and an <br />additional 35-foot high pole sign at 1241 East 17th Street, Santa <br />Ana, california, in a C-4 District, subject to certain conditions; <br />and <br /> <br /> W~EREAS, Appeal Application No. 224 was duly filed by Rohrs <br />Investment Company appealing Condition Number 2 attached to the <br />approval of said variance 69-56, which condition prohibited the <br />installation of a freestanding sign on the subject property; and <br /> <br /> WHEREAS, after public hearing on notice, the City Council <br />has determined that Condition No. 2 should be deleted from the <br />conditions of approval of said Variance 69-56; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the city Council of <br />the city of Santa Ana does hereby overrule the decision of the <br />Planning Commission and does hereby grant a variance on variance <br />Application 69-56, filed by ROHRS INVESTMENT COMPANY to permit a <br />sign not to exceed 180 square feet per face, a maximum of a 5-foot <br />projection, and a maximum height of 35 feet, in lieu of the free- <br />standing sign heretofore approved for construction at the intersection <br />of 17th Street and Grand Avenue per variance Application 68-9; said <br />Variance is granted subject to the following conditions: <br /> <br />1. That a revised plot plan be submitted to and approved by the <br /> Planning Department indicating the offstreet parking stalls <br /> east of the restaurant be so designed that there will be no <br /> direct access to the major access on Seventeenth Street to <br /> the shopping center, and that the development be according <br /> to the revised plot plan except for minor modifications <br /> approved by the Planning Department; <br /> <br />2. That roof or fin signs shall be p~mitted on the proposed <br /> structure and that any signs shall not exceed an area equal <br /> to 20% of the building elevation to which the sign is <br /> attached; <br /> <br />3. That all mechanical apparatus be baffled for sound and attrac- <br /> tively screened from view; <br /> <br />That a.landseape plan be submitted to and approved by the <br /> Planning Department and that said plan be implemented and <br /> consist of a balanced combination of trees, shrubs and <br /> ground cover; <br /> <br />5. That a complete system of underground electrical and telephone <br /> utilities be provided. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF A BUILDING PERMIT: <br /> <br />e <br /> <br />Furnish the Department of Public Works a final grading plan and <br /> an on-site drainage flow plan showing the direction of flow <br /> to the adjacent streets when this property is developed; <br /> <br />Submit a revised plot plan showing no new drive and omitting <br /> three parking stalls adjacent to the future service station <br /> and adjacent to Seventeenth Street for on-site vehicular <br /> circulation - to be approved by Public Works Department. <br /> <br />-1- <br /> <br /> <br />
