RESOLUTION 69-157 AUTHORIZING THE ATTORNEY GENERAL <br />OF THE STATE OF CALIFORNIA TO CONDUCT LEGAL <br />PROCEEDINGS FOR THE CITY OF SANTA ANA <br /> <br /> WHEREAS, the Office of the Attorney General of the State of <br />California is conducting an investigation into an alleged conspiracy <br />among various automobile manufacturers and the Automobile Manufac- <br />turers Association to retard the introduction of smog control devices <br />into California; and <br /> <br /> WHEREAS, it is contemplated that the Attorney General will <br />file on behalf of the State of California and of the cities and <br />counties of the State an action to recover damages for suffering <br />due to smog attributable ultimately to such companies and association; <br />and <br /> <br /> WHEREAS, the Attorney General has asked for authority to <br />represent the interests of the City of Santa Ana in these proceedings; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the Attorney General <br />of California, or any of his authorized assistants or deputies, be <br />authorized to take such action on our behalf and in our name, as, <br />in his sole discretion, may be deemed appropriate in the preparation, <br />filing, service and prosecution of a civil Antitrust Suit for <br />damages and other legal recovery against certain automobile manufac- <br />turers for conspiring to retard the introduction of smog control <br />devices in the State of California; <br /> <br /> BE IT FURTHER RESOLVED: That this authorization includes <br />the authority to settle such litigation on such terms as the <br />Attorney General or any of his authorized assistants or deputies <br />may deem appropriate, and to allocate to us our proper and equitable <br />share of any sum recovered as damages, excepting the amount of <br />attorneys' fees, costs, and expenses incurred by the Attorney General, <br />as determined or approved by the Court, whether by settlement, suit, <br />or otherwise. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of <br />Ana at its regular meeting held on the <br /> <br />ATTEST: <br /> <br />CLERK OF THE COLrNCIL <br /> <br /> Santa <br />20th day of October, 1969. <br /> <br /> MAYOR <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br />SS <br /> <br /> I, FLORENCE I.
