RESOLUTION 70-74 AUTHORIZING CONDEMNATION OF <br />PARCELS OF REAL PROPERTY NORTHEAST OF THE <br />INTERSECTION OF FIFTH AND HARPER STREETS <br />FOR PARK PURPOSES <br /> <br /> WHEREAS, the Santa Ana General Plan Program recommends the <br />acquisition and development of a six-acre neighborhood park by <br />fiscal year 1969-70 near the intersection of Fifth and Harper <br />Streets; and <br /> <br /> WHEREAS, the parcel hereinafter described is the only one <br />in the area suitable for said purpose; <br /> <br /> N(I~, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby find and declare that the public <br />interest and necessity require the acquisition of fee title in and <br />to the real property hereinbelow described: <br /> <br />That portion of the Northeast Quarter of the Southwest Quarter <br />of Section 10, Township 5 Sou~h, Range 10 West, in the Rancho <br />Las Bolsas, in the City of Santa Ana, County of Orange, State <br />of California, as shown on a map thereof recorded in Book 51, <br />Page 12 of Miscellaneous Maps, records of said Orange County, and <br />that portion of Tract Number 447 as shown on a map recorded in Book <br />17, Page 12 of Miscellaneous Maps, records of said Orange County <br />described as follows: <br /> <br />Beginning at the Northwest corner of Lot 9 of said Tract Number <br />447, and running thence North, along the northerly prolongation <br />of the West line of sa~d Lot 9, a distance of 460.00 feet; <br />thence East, parallel with the North line of said Tract Number 447, <br />a distance of 130.00 feet to the northerly prolongation of the <br />East line of Lot 10 of said Tract Number 447; thence southerly, <br />along said northerly prolongation and along the easterly line <br />of said Lot 10, a distance of 600 feet to the southeast corner <br />of said Lot 10; thence westerly a distance of 130.00 feet to <br />the SouthweSt corner of Lot 9 of said Tract Number 447; thence <br />North along the west line of said Lot 9, a distance of 140.00 .~ <br />feet to the point of beginning. <br /> <br />BE IT FURTHER RESOLVED: <br /> <br /> 1. That the City Attorney is hereby ordered to bring an <br />action in the name of the City to condemn said property necessary <br />to be taken and to do all things necessary to prosecute said action <br />to final determination; <br /> <br /> 2. That said public improvement is planned and located in <br />a manner which will be most compatible with the greatest public <br />good and the least private injury; <br /> <br /> 3. That the City of Santa Ana is authorized and empowered <br />to acquire, develop, maintain, and operate public parks within <br />and without the City; <br /> <br /> 4. That said action in condemnation shall be taken in <br />accordance with the provisions of the Code of Civil Procedure and <br />the Constitution of the State of California relating to eminent <br />domain. <br /> <br />-1- <br /> <br /> <br />
