RESOLUTION 71-1 UPHOLDING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE <br />ON VARIANCE APPLICATION 70-54 FILED BY LAND <br />EVOLUTION, INC., SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on Variance Application 70-54, <br />filed by LAND EVOLUTION, INC. to permit the construction of a <br />17-unit garden apartment development in the R-1 District at <br />1636 East Sixth Street, Santa Ana, California; and <br /> <br /> WHEREAS, Appeal Application No. 251 was duly filed by <br />MARGARITA E. CORTEZ appealing the decision of the Planning <br />Commission to grant said Variance and presenting the matter to <br />the City Council; and <br /> <br /> WI~EREAS, the City Council, after public hearing on notice <br />has determined that said Variance Application meets the require- <br />ments of Section 41-638 of the Santa Ana Municipal Code and that <br />said Variance should be granted subject to certain applicable <br />conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby affirm the decision of the <br />Planning Commission and does hereby grant a variance on Variance <br />Application 70-54, filed by LAND EVOLUTION, INC., to permit the <br />construction of a 17-unit garden apartment development in the <br />R-1 District at 1636 East Sixth Street, Santa Ana, California; <br />said variance is granted subject to the following conditions: <br /> <br />That development be according to the approved plot plan except <br /> for minor modifications to be approved by the Planning <br /> Department; <br /> <br />2. That the manager's two bedroom apartment have a floor area of <br /> 800 square feet or more; <br /> <br />3. That the proposed trash area, as indicated on the plot plan,be <br /> enclosed by a 5-foot high solid wall or fence and solid gate; <br /> <br />That a 6-foot high solid fence or masonry wall be constructed <br /> along the westerly property line, and terminate 19 feet back <br /> from the front property line on Sixth Street; <br /> <br />That a landscape plan be submitted to and approved by the <br /> Planning Department which will be implemented and will show <br /> a balanced combination of trees, shrubs and ground cover; <br /> said landscaping shall be provided with permanent watering <br /> devices and be permanently maintained; <br /> <br />6. That all requirements of the Building Department be met. <br /> <br />The following conditions are to be complied with prior to the <br />issuance of a building permit: <br /> <br />o <br /> <br />Furnish the Department of Public Works a final grading plan and <br /> an on-site drainage flow plan showing the direction of flow <br /> to the adjacent streets when this property is developed. <br /> Plan is to include existing and proposed elevations at <br /> ge property lines; <br /> <br />8. Pay drainage assessment fee; <br /> <br />9. Pay sewer reimbursement; <br /> <br />-1- <br /> <br /> <br />
