RESOLUTION 71-15 AFFIRMING THE DECISION OF THE <br />P~ANlqING COMMISSION AND DENYING A PORTION OF <br />VARIANCE APPLICATION 70-61 FILED BY SANTA ANA <br />LINCOLN MERCURY <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission denied a portion of Variance Application 70-61, filed <br />by SANTA ANA LINCOLN MERCURY to permit a 31-foot high off premise <br />advertising sign and a 30-foot high on premise sign adjacent to <br />the Newport Freeway in the A-1 District at 1301 North Tustin Avenue, <br />Santa Ana, California; and <br /> <br /> WHEREAS, Appeal Application 248 was duly filed by the <br />applicant appealing the decision of the Planning Commission to <br />deny that portion of Variance Application 70-61 requesting <br />permission to erect a 31-foot high off premise sign, and presenting <br />the matter to the City Council; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br />City of Santa Ana does hereby affirm the decision of the Planning <br />Commission and does hereby DENY that portion of Variance Application <br />70-61, filed by SANTA ANA LINCOLN MERCURY requesting permission to <br />erect a 31-foot high off-premise sign adjacent to the Newport <br />Freeway; <br /> <br /> BE IT FURTHER RESOLVED: That the remaining portion of <br />said Variance Application 70-61, filed by SANTA ANA LINCOLN-MERCURY, <br />is hereby granted to permit a 30-foot high on-premise sign adjacent <br />to the Newport Freeway in the A-1 District at 1301 North Tustin <br />Avenue, Santa Ana, California; said portion of Variance 70-61 is <br />granted subject to the following conditions: <br /> <br /> 1. That only the proposed on-premise sign be permitted <br />on the subject property adjacent to the Newport Freeway, and that <br />it conform to all provisions of Section 41-619.6 of the Santa Aha <br />Municipal Code relating to Advertising Signs Adjacent to Freeways; <br /> <br /> 2. That the proposed sign may be illuminated but shall <br />not flash, blink, or rotate; <br /> <br /> THE FOLLOWING CONDITION IS TO BE COMPLIED WITH PRIOR TO THE <br />INSTALLATION OF THE SIGNS: <br /> <br /> 3. Pay for future ornamental street lights with underground <br />connections. <br /> <br /> PASSED AiqD ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 1st day of February, 1971. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYOR <br /> <br />-1- <br /> <br /> <br />
