RESOLUTION 71-27 OVERRULING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION 70-77, FILED BY YSIDRO AND <br />ANITA RUVALCAVA, SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission DENIED a variance on Variance Application 70-77 <br />filed by YSIDRO and ANITA RUVALCAVA proposing to permit open <br />storage of construction equipment and material in the A-1 <br />District at 937 and 941 South Lyon Street, Santa Ana, <br />California; and <br /> <br /> WHEREAS, Appeal Application No. 260 was duly filed by <br />the applicant, appealing the decision of the Planning Commission <br />and presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said Variance Application meets the require- <br />ments of Section 41-638 of the Santa Ana Municipal Code and that <br />said Variance is granted subject to certain applicable conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby overrules the decision of the <br />Planning Commission and does hereby grant a variance on variance <br />application 70-77, filed by YSIDRO and ANITA RUVALCAVA, to <br />permit open storage of construction equipment and material in <br />the A-1 District at 937 and 941 South Lyon Street, Santa Ana, <br />California; Said Variance is granted subject to the following <br />conditions: <br /> <br />That development be according to the approved plot plan <br /> except for minor modifications to be approved by the <br /> Department; <br /> <br />Planning <br /> <br />2. That materials stored not extend above the 6' high solid <br /> wooden fence; <br /> <br />That equipment which is more than 6' high be stored toward <br /> the middle of the property (away from the kennel on the <br /> north and the residence on the south); <br /> <br />4. That all material and equipment be kept within the storage <br /> area at all times; <br /> <br />Se <br /> <br />That on the northerly lot, the 6' high solid wooden fence <br /> be extended from the side property line southerly to the <br /> existing storage shed and a solid gate be installed at <br /> this access point; <br /> <br />e <br /> <br />That if either of the lots be sold and the storage thereon <br /> discontinued, the storage yard on the remaining lot be <br /> completely enclosed with a 6' high solid fence or wall; <br /> <br />7. That all requirements of the Building and Fire Departments <br /> be met; <br /> <br />That this variance shall become null and void two (2) years <br /> from the date of approval unless extended for one (1) <br /> year by the Planning Department. <br /> <br />9. The following condition is to be complied with prior to the <br /> above use: <br /> <br />Provide a street easement for Lyon Street for a width of <br />30 feet from monumented center line to property line. <br /> <br />-1- <br /> <br /> <br />
