RESOLUTION 71-41 DECLARING THE COUNCIL'S <br />INTENTION TO COMMENCE ANNEXATION OF CERTAIN <br />IRVINE PROPERTY DESCRIBED IN THE SETTLEMENT <br />AGREEMENT OF MAY 20, 1963 AND DIRECTING THE <br />MAYOR TO EXECUTE AND TRANSMIT A WRITTEN <br />NOTICE TO THE IRVINE COMPANY <br /> <br /> WHEREAS, the City of Santa Ana entered into a settlement <br />agreement with the Irvine Company by a written instrument dated <br />May 20, 1963; and <br /> <br /> WHEREAS, by the expressed terms of said written agreement <br />the Irvine Company was required, upon written request of the <br />Council to commence annexation of a particularly described <br />parcel of real property to the City of Santa Ana; and <br /> <br /> WHEREAS, by further terms of the said settlement agreement <br />the Irvine Company is required to exercise its right as an owner <br />to prevent incorporation into a city or annexation by another <br />city of the real property as particularly described in the <br />settlement agreement or any part thereof; and <br /> <br /> WHEREAS, it appears that there is now in progress <br />incorporation proceedings involving the afore described real <br />property in derrogation of the City's right under the settlement <br />agreement; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby declares its intention to exercise <br />all rights of the City of Santa Ana of which it is possessed by <br />reason of the settlement agreement of May 20, 1963 and which <br />hereby expressly authorizes that written notice be served upon <br />the Irvine Company notifying it of the city's decision aforesaid <br />and notifying it further that the City of Santa Aha is calling <br />upon it to honor all commitments made by it in the settlement <br />agreement, both explicit and implicit. <br /> <br /> IT IS FURTHER RESOLVED: That the Mayor of the City of <br />Santa Ana is hereby authorized and directed to prepare, execute <br />and serve such written notice. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 3rd day of May, 1971. <br /> <br />MAYO R <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA ) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br />SS <br /> <br /> I, FLORENCE I.
