RESOLUTION 71-45 OVERRULING THE DECISION OF <br />THE PLANNING COMMISSION AND GRANTING A <br />VARIANCE ON VARIANCE APPLICATION 71-12 <br />FILED BY SAN BERNARDINO-RIVERSIDE COUNCIL <br />OF CHURCHES, SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission denied a variance on Variance Application 71-12 filed <br />by SAN BERNARDINO-RIVERSIDE COUNCIL OF CHURCHES to construct <br />a twelve story, 250 unit residential development for elderly <br />people in the C 4 District less than 140 feet from the R-1 <br />District at 711 North Bristol Street, Santa Ana, California; and <br /> <br /> WHEREAS, Appeal Application 266 was duly filed by <br />S. ARTHUR MARTINEZ, appealing the decision of the Planning <br />Commission and presenting the matter to the City Council; and <br /> <br /> WP~EREAS, The City Council, after public hearing, on notice, <br />has determined that the decision of the Planning Commission should <br />be overruled and that said Variance is granted, subject to certain <br />applicable conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby overrules the decision of the Planning <br />Commission and does hereby grant a variance on Variance Application <br />71-12, filed bySAN BERNARD INO-RIVERSIDE COUNCIL OF CHURCHES, to <br />to permit the construction of a twelve story, 250 unit residential <br />development for elderly people at 711 North Bristol Street, <br />Santa Ana, California, in the C-4 District, less than 140 feet <br />from the R-1 District; said Variance is granted subject to the <br />following conditions: <br /> <br />1. That development be according to'the approved plot plan except <br /> for minor modifications approved by the Planning Department; <br /> <br />That a landscape plan be submitted to and approved by the <br /> Planning Department. Said landscaping shall be implemented <br /> according to the landscape plan and be continuously <br /> maintained; <br /> <br />3. That the development be surrounded by a solid masonry wall, ~ <br /> except along street frontages, the height of which shall be i <br /> in accordance with Section 41-610 of the Santa Ana <br /> Municipal Code; <br /> <br />4. That all units meet the minimum square footage of gross floor <br /> area of the R 3 District (i.e. 300 Square feet for <br /> bachelor units, 500 Square feet for one bedroom units); <br /> <br />That additional offstreet parking stalls may be required on <br /> the site if the complex is not utilized as a residence <br /> for the elderly. <br /> <br />6. That all conditions of the Building and Fire Departments <br /> be met. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF A BUILDING PERMIT: <br /> <br />7. Submit a revised plot plan showing only one drive on Bristol <br /> Street to be over the southerly 40 feet of this property; <br /> <br />NOTE: <br /> <br />Bristol Street has an existing median island left turn <br />pocket to provide for left turn movement into this property <br />only at the location mentioned above.
