RESOLUTION 71-47 AUTHORIZING PETITION TO T~E <br />BOARD OF SUPERVISORS OF ORANGE COUNTY REQUESTING <br />EXCLUSION OF PROPERTY WITHIN THE CITY OF SANTA <br />ANA , CALIFORNIA, FROM THE LEVY OF ANY ORANGE <br />COUNTY TAX TO PROVIDE STRUCTURAL FIRE PROTECTION <br />AND MAKING FINDINGS OF FACT <br /> <br /> W~EREAS, the City of Santa Ana is a municipal corporation <br />now existing as such by virtue of a charter granted under the laws <br />of the State of California; and <br /> <br /> W/~EREAS, the California Government Code §25643 provides that <br />the Board of Supervisors shall except from the levy of any tax for <br />structural fire protection all property within a city petitioning <br />therefor where the petition is supported by a resolution adopted <br />by the City Council which makes certain findings; <br /> <br /> NOW, THEP~EFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby finds and declares that Santa Ana is <br />an incorporated City which has in operation and existence an <br />organized fire department that, at the time of adoption of this <br />Resolution, and for many decades last past, has been adequately <br />staffed by competent, well-trained personnel under outstanding <br />leadership, equipped with modern fire fighting equipment of all <br />necessary kinds, and sufficiently supplied with fire fighting <br />chemicals, which said Department has access to the Santa Ana water <br />system maintained at high pressure; that the excellence and ade- <br />quacy of said Fire Department, its equipment, chemicals, and <br />personnel and the water system of the City, including the reser- <br />voirs and mains and the pressure of the water supply for fire <br />fighting purposes, have been determined by the American Insurance <br />Association, Committee on Fire Prevention and Engineering Standards, <br />to be among the best in the State of California and the best in <br />Orange County, California, so that Santa Ana now has the lowest <br />fire insurance premium rate existing anywhere in this area; that <br />Santa Ana is now providing adequate structural fire protection to <br />all property within the incorporated limits of the City and that <br />no additional benefit in fire protection is or would be received <br />or required by such property from structural fire protection given <br />by the County of Orange. <br /> <br /> BE IT FURTHER RESOLVED: That the said City Council hereby <br />authorized and directs that a petition be presented to the <br />Honorable Board of Supervisors of Orange County, California, <br />attached to and supported by a certified copy of this Resolution, <br />petitioning said Board to exclude and except from the levy of any <br />tax imposed by the County of Orange for structural fire protection <br />all property within the limits of the City of Santa Ana, California, <br />and Carl J. Thornton, City Manager, is hereby authorized and <br />directed to sign said Petition, a copy of which is attached to <br />this Resolution, and to present the original thereof, together <br />with a certified copy of this Resolution, to the said Board of <br />Supervisors before July 1, 1971. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 17th day of May, 1971. <br /> <br />ATTEST: ~ ~ <br />CLERK OF THE COUNCIL <br /> <br />-1- <br /> <br /> <br />
