RESOLUTION 71-55 OVERRULING THE DECISION <br />OF THE ZONING ADMINISTRATOR AND GRANTING <br />A VARIANCE ON VARIANCE APPLICATION 71-23 <br />SUBJECT TO CONDITIONS OF APPROVAL CONTAINED <br />IN THE FINDING OF FACT <br /> <br />ASSISTANT <br /> <br /> WHEREAS, after public hearing, on notice, the Zoning <br />Administrator DENIED a variance on Variance Application 71-23 <br />filed by JESUS GUILLERMO GARCIA to construct a duplex on a <br />lot with an existing single family dwelling and a duplex in the R-1 <br />District at 821 - 823 North English Street, Santa Aha, California; <br />and <br /> <br /> WHEREAS, Appeal Application 269 was duly filed by the <br />applicant appealing the decision of the Zoning Administrator and <br />presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing, on <br />notice, has determined that said variance should be granted, <br />to certain applicable conditions; <br /> <br />subject <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City <br />Council of the City of Santa Ana hereby overrules the decision of <br />the Zoning Administrator and does hereby grant a variance on <br />Variance Application 71-23, filed by JESUS GUILLERMO GARCIA <br />to permit the construction of one additional dwelling unit on a lot <br />with an existing single family dwelling and a duplex in the R-1 <br />Distruct at 8Z1-823 North English Street, Santa Aha, California; <br />said Variance is granted subject to the following conditions: <br /> <br />Planning Department Requirements Z and 5; <br /> <br />b. Public Works requirements 10 and 16; <br /> <br />as set forth in Exhibit A attached hereto and made a part hereof <br />as though set forth in full; <br /> <br />The following conditions are also attached to said approval: <br /> <br />That a revised plot plan be submitted to and approved by <br /> the Planning Department and that development be according <br /> to the approved revised plot plan except for minor <br /> modifications to be approved by the Planning Department; <br /> <br />That only one (1) additional dwelling unit be shown on the <br /> revised plot plan. <br /> <br />That there be a total of 6 off-street parking spaces, at <br /> least 4 covered and g open spaces; and <br /> <br />That there be a rear yard of at least 20 feet. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its regular meeting held on the 7th day of June <br />1971. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYOR <br /> <br />-1- <br /> <br /> <br />
