RESOLUTION 71-63 APPROVING MAP AND DECLARING <br />INTENTION TO VACATE ALLEY ON NORTH SIDE OF <br />CIVIC CENTER DRIVE BETWEEN ROSS STREET AND <br />VAN NESS AVENUE; RESERVING AN EASEMENT THEREIN <br />FOR PACIFIC TELEPHONE COMPANY AND GIVING NOTICE <br /> OF HEARING THEREON: <br /> <br /> WHEREAS, theDepartment of Public Works and Planning <br />Commission have recommended a public hearing be set on the question <br />of said vacation, a request for the vacation of that certain alley <br />on the north side of Civic Center Drive between Ross Street and <br />Van Ness Avenue, herein described, has been received by the City <br />Council. <br /> <br /> WHEREAS, the Orange County Employees Association has <br />received a variance to erect an eight story office building <br />and the abandonment of said alley was conditioned on the <br />improvement and dedication of a 20' east/west alley between <br />Ross Street and Van Ness Avenue located at the northern portion <br />of the proposed abandoned alley. <br /> <br /> NOW, THEREFORE, BE IT P~ESOLVED: That the City Council <br />hereby approves the map attached hereto and orders the same <br />filed with the original of this Resolution in the office of <br />the Clerk of the Council, and reference is hereby made to said <br />map for the exterior boundaries of said right of way proposed <br />to be vacated. <br /> <br /> The City Council declares its intention to proceed under <br />the provisions of the Street Vacation Act of 1941 (Section 8300 <br />through 8374 of the California streets and Highway Code) to vacate <br />that certain alley lying northerly on Civic Center Drive, between <br />Ross Street and Van Ness Avenue, and RESERVING THEREIN an easement <br />for utility structures for the Pacific T~lephone Co. Said right <br />of way proposed to be vacated lies in the City of Santa Ana, <br />County of Orange, State of California, and is described as: <br /> <br />Ail that portion of an 18 foot alley as shown on a map <br />of Townsend Tract in the City of Santa Ana recorded <br />in Book 4, Page 30 of Miscellaneous Maps, records of <br />Orange County, California bounded Northerly by a line <br />parallel with and distant 20.00 feet Southerly, measured <br />at right angles, from the North line of said Townsend <br />Tract also being the North line and the Easterly pro- <br />longation of the North line of Lot 11 of said Townsend <br />tract and bounded Southerly by a line ~arallel with <br />and distant 30.00 feet Northerly, measured at right <br />angles from the center line of Hickey Street, now called <br />Civic Center Drive West. <br /> <br />Reserving an easement over the easterly 6.00 feet of <br />the above described 18 foot alley to construct, place, <br />operate, inspect, maintain, repair, replace and remove <br />such aerial and underground telephone, telegraph and <br />communication structures as the company may from time <br />to time require, consisting of poles, anchors, wires, <br />cables, conduits, manholes, markers and necessary fixtures <br />and appurtenances. <br /> <br />Also reserving all vehicular access rights to Civic Center <br />Drive West from the lands lying Northerly of the Southerly <br />line of the above described 18 foot alley. <br /> <br />- 1 - <br /> <br /> <br />
