RESOLUTION 71-66 AFFIRMING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A CONDITIONAL USE PERMIT ON APPLICATION 71-13 FILED BY MARGARET J. BRENNAN, SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission granted a conditional use permit on application 71-13, filed by MARC=Al{ET J. BIRENNAN to expand an existing rest home in the R-1 District at 2131 South Parton Street, Santa Ana, California; and WHEREAS, Appeal Application 274 was duly filed by VAN SMOOT of 2101 South Parton Street, appealing the decision of the Planning Cormnission and presenting the matter to the City Council; and WHEREAS, the City Council, after public hearing, on notice, has determined that the decision of the Planning Commission should be upheld; that said Conditional Use Permit meets the requirements of Section 41-638 of the Santa Ana Municipal Code and that said Conditional Use Permit should be granted subject to certain applicable conditions; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana does hereby affirm the decision of the Planning Commission and does hereby grant a Conditional Use Permit on Application 71-13, filed by MARGARET BRENNAN, to permit the expansion of an existing rest home in the R-1 District at 2131 South Parton Street, Santa Ana, California; said Conditional Use Permit is granted subject to the following conditions: 1. That the number of .guest~ shall not exceed seven (7) persons as per the original Conditional Use Permit No. 68-13. 2. Planning Department requirements 1 and 2. and 3. Public Works requirement 16; as set forth in Exhibit A attached hereto and made a part hereof as though set forth in full; 4. That a plan be submitted to and approved by the Planning Department for a trash enclosure. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 6th day of July, 1971. ATTEST: CLERK OF THE COUNCIL MAYOR -1-
