RESOLUTION 71-73 ORDERING THE VACATION OF A PRIOR STREET DEDICATION OF A PORTION OF BIRCH STREET AND ALTON AVE. W~EREAS, on recommendation of the Department of Public Works the City Council is of the opinion that by reason of a minor re- location of Birch Street and Alton Avenue two small portions of the presently existing roadway should be summarily vacated and abandoned in the manner prescribed in Chapter 5, Division 2.5 of the Streets and Highways Code (commencing with section 1930); and W~EREAS, the total area involved is approximately 480 square feet; NOW, THEREFORE, BE IT RESOLVED that the following described portions of real property, lying within the public right-of-way, but which by reason of a minor relocation of Birch Street and Alton Avenue are no longer required as a public right-of-way, he and are hereby summarily vacated and abandoned: Those portions of Birch Street, in the City of Santa Ana, County of Orange, State of California, as shown on map of Tract No. 7086, recorded in Book 268, pages 32 and 33 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: PARCEL 1: That portion of said Birch Street, lying Northerly of the following described line: Beginning at the most Northeasterly corner of the boundary of Tract No. 7163, as shown on map recorded in Book 279, pages 30 through 32, inclusive of the Miscellaneous Maps of said County; thence along the Southeasterly prolongation of the Northeasterly boundary of said Tract No. 7163, S 77° 00' 53" E 13.37 feet; thence N 89° 57' 59" E to its inter- section with the Northeasterly line of said Birch Street. PARCEL 2: That portion of said Birch Street, lying Easterly and Southeasterly of the following described line: CoK~encing at the Northerly terminus of that certain course on the centerline of said Birch Street, shown on said map of Tract No. 7086 as having a bearing and length of "N 0° 39' 51" E 517.63 feet"; thence N 89° 57' 59" E 42.48 feet; thence at right angles S 0° 02' 01" E 30.00 feet to a point on a curve concave Southeasterly having a radius of 13.00 feet to which a tangent line bears N 89° 57' 59" E, said point being the True Point of Beqinning; thence Westerly, Southwesterly and Southerly along said curve through a central angle of 89° 18' 08" a distance of 20.26 feet to a point of tangency on a line parallel with and distant Easterly 30.00 feet from said certain course; thence along said parallel line S 0° 39' 51" W to the Southerly terminus of that certain curve concave Easterly having a radius of 38.00 feet and a central angle of 9° 43' 37" on the Easterly line of said Birch Street as shown on said map of Tract No. 7086.
