RESOLUTION 71-88 CONDITIONALLY GRANTING VARIANCE <br />APPLICATION 71-33 FILED BY EBELL SOCIETY OF SANTA <br />ANA VALLEY <br /> <br /> BE IT RESOLVED: That, based upon the Findings of Fact <br />of the Planning Commission and testimony presented before the <br />City Council, the City Council of the City of Santa Ana hereby <br />reverses the decision of the Planning Commission, and Variance <br />Application 71-33 (To allow an auto repair business in an exist- <br />ing building in the R 3 H District at 511 E. Santa Ana Boulevard.) <br />is granted subject to conditions of approval contained in the <br />Commission Report which are as follows: <br /> <br />That development be according to the approved <br />plot plan, except for minor modifications ap- <br />proved by the Planning Department. <br /> <br />2. That all conditions of the Building and Fire <br /> Departments be met. <br /> <br />3. Dedicate required street or alley right of way. <br /> <br />4. Provide a ten-year continuing offer of dedica- <br /> tion for required street right of way. <br /> <br />5. Pay street lighting deposit for future street <br /> lights. <br /> <br />Required property dedications shall be initiated <br />by the owner, through the Department of Public <br />Works, at least four weeks prior to application <br />for a building permit, or use as applicable, to <br />avoid delay. <br /> <br />The following requirements must also be met: <br /> <br />1. Ail activity and any storage be within the <br /> existing building. <br /> <br />2. Ail operation be confined to the hours between <br /> 8:00 A.M. and 8:00 P.M. <br /> <br />The existing chain link fence on adjacent lots <br />14 and 15 be moved to the westerly property line <br />of the subject property. <br /> <br />Dedications: <br /> <br />1. Santa Ana Boulevard <br /> <br />(a) <br /> <br />For a width of 52 feet from center <br />line excepting the area where the <br />existing building stands. <br /> <br />(b) <br /> <br />Continuing offer of dedication for <br />a width of 52 feet from center line <br />to property line in the area that <br />the existing building occupies. <br /> <br />NOTE: <br /> <br />The applicant should investigate standard fee <br />for future ornamental street lights. <br /> <br />Page - 1 - <br /> <br /> <br />
