RESOLUTION 71-91 UPHOLDING THE DECISION OF THE <br />PLANNING COMMISSION AND CONDITIONALLY GRANTING <br />CUP ~71-17 FILED BY ERNEST & LILLIAN R. CAPP <br /> <br /> BE IT RESOLVED: That, based upon the Findings of Fact of the <br />Planning Commission and testimony presented before the City Council, <br />the City Council of the City of Santa Ana hereby upholds the deci- <br />sion of the Planning Commission, and Conditional Use Permit ~71-17 <br />filed by Ernest & Lillian R. Capp, to allow a pre-school and day <br />care center in the R 2 District (1630 E. Palm Ave., Santa Ana) is <br />granted subject to conditions of approval contained in the Commis- <br />sion Report which are as follows: <br /> <br />1. That all conditions of the Building and Fire <br /> Departments be met. <br /> <br />That a landscape plan be submitted to and ap- <br />proved by the Planning Department, including <br />the provisions of Sec. 41-618 of the Zoning <br />Ordinance, and that said landscaping be im- <br />plemented and be continuously maintained. <br /> <br />Submit to the Department of Public Works, for <br />their approval, an acceptable final grading plan <br />or an on-site drainage plan or both, showing the <br />direction and means of flow to the adjacent street <br />or channel when this property is developed. Plan <br />is to include existing and proposed elevations at <br />the property lines· Applicants should check with <br />the Department of Public Works for extent of study <br />needs. <br /> <br />4. Dedicate required street or alley right of way. <br /> <br />5. Pay drainage assessment fee. <br /> <br />6. Pay street lighting deposit for future street <br /> lights. <br /> <br />7. Repair or replace existing street improvements <br /> to City standards: Driveway. <br /> <br />Ail public improvement construction shall be <br />subject to inspection and approval by the De- <br />partment of Public Works. <br /> <br />w <br /> <br />Required property dedications shall be initiated <br />by the owner, through the Department of Public <br />Works, at least four weeks prior to application <br />for a building permit, or use as applicable, to <br />avoid delay. <br /> <br />The following requirements must also be met: <br /> <br />1. The number of students shall be limited to a <br /> maximum of 60. <br /> <br />That a revised plot plan be submitted and ap- <br />proved by the Planning Department except for <br />minor modifications to be approved by the <br />Planning Department. <br /> <br />That the revised approved plot plan show all <br />but the most southerly open parking space at <br />90° angles to the side property line. <br /> <br />- 1 - <br /> <br /> <br />
