RESOLUTION NO. 71-102 <br /> <br />RESOLUTION DETERMINING THAT THE PUBLIC CONVENIENCE <br />AND NECESSITY REQUIRE IMPROVEMENT WORK <br /> <br /> ASSESSMENT DISTRICT NO. 225 <br /> SANTA ANA, CALIFORNIA <br /> <br /> WHEREAS, the City Council of the City of Santa Ana, <br />California did, on the 7th day of September, 1971, in adopting <br />its Resolutions No. 71-82 and 71-83 in this assessment district, <br />order that a public hearing be held on the 1st day of November, <br />1971 at 7:30 o'clock P.M. in the council chambers in the City <br />Hall Annex in said City of Santa Ana concurrently with the pro- <br />test hearing under its Resolution of Intention No. 71-83 for the <br />purpose of finding and determining whether the public convenience <br />and necessity require the improvements proposed to be constructed as <br />described in said Resolution of Intention No. 71-83; and <br /> <br /> WHEREAS, notice of the adoption of said Resolution <br />No. 71-82 and of said Resolution of Intention No. 71-83 by mail- <br />ing, posting and publication was given in the time, form and <br />manner as required by law, as shown by the affidavits of mailing, <br />posting and publication on file in the office of the Clerk of the <br />Council of said City of Santa Ana; and <br /> <br /> WHEREAS, protests or objections, in writing, were made <br />by 62.6% of the owners of real property within the assessment <br />district proposed under said Resolution of Intention No. 71-83 to <br />the formation of said assessment district; and <br /> <br /> WHEREAS, said City Council received testimony from the <br />Director of Public Works of said City of Santa Ana, owners and <br />residents of real property, both within and without said assess- <br />ment district, and interested organizations, both public and <br />private, that said proposed work and improvement is required for <br />the public convenience and necessity; and <br /> <br /> WHEREAS, the oral protests against the formation of <br />said assessment district were limited primarily to the cost <br />thereof as distinguished to the necessity therefor. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Santa Aha, California, in regular session assembled <br />this 1st day of November, 1971, that said City Council hereby <br />finds and determines that said proposed work and improvement is <br />feasible, and that the public interest, convenience and necessity <br />require such improvement, and that all protests, both oral and in <br />writing, to the doing of said work be and the same hereby are <br />overruled and denied. <br /> <br />ADOPTED the 1st day of November, 1971. <br /> <br />Mayor <br /> <br />ATTEST: <br /> <br />Clerk of the Council <br /> <br /> <br />
