RESOLUTION 72-34 <br /> <br />GRANTING APPEAL #295 AND APPROVING <br />VARIANCE APPLICATION 72-15 FILED BY <br />CHARLES B. LINGER <br /> <br /> BE IT RESOLVED: That, based upon the Findings of <br />Fact of the Planning Commission, the City Council of the <br />City of Santa Ana does hereby overrule the decision of <br />the Planning Commission, and Appeal #295 on Variance <br />Application 72-15 filed by Charles B. Linger to allow <br />expansion of non-conforming commercial use with less <br />than required parking at 326-28, 30 W. 17th Street <br />(C 1 HD II District) is hereby granted, subject to the <br />following conditions: <br /> <br />1. That all conditions of the Building and Fire <br /> Departments be met. <br /> <br />2. That any trash areas be enclosed in accordance <br /> with the Planning Department standards. <br /> <br />3. Pay street lighting deposit for future street <br /> lights. <br /> <br />The following requirements must also be met: <br /> <br />Applicant submit fully dimensioned plot plan and <br />elevations in a manner meeting the approval of <br />the Planning Department. <br /> <br />Remove the existing off-premise signs (2 billboards). <br />No off-premise sign shall be relocated on the <br />property and no new off-premise sign shall be <br />constructed on the property. <br /> <br />3. Ail on-premise signs shall conform to the Sign <br /> Ordinance. <br /> <br />4. The premises will be limited to two uses. <br /> <br />Se <br /> <br />The council action varies the strict application of <br />the parking requirements and standards of the code <br />as they apply to this site and the applicant will <br />be permitted to continue the parking use as it <br />presently exists. <br /> <br />PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its regular meeting held on the 1st day of <br /> MaY , 1972. <br /> <br />ATTEST: <br /> <br />MAYOR <br /> <br />- 1 - <br /> <br /> <br />
