RESOLUTION 72-43 AUTHORIZING PETITION TO THE <br />BOARD OF SUPERVISORS OF ORANGE COUNTY REQUES- <br />ING EXCLUSION OF PROPERTY WITHIN THE CITY OF <br />SANTA ANA, CALIFORNIA, FROM THE LEVY OF ANY <br />ORANGE COUNTY TAX TO PROVIDE STRUCTURAL FIRE <br />PROTECTION AND MAKING FINDINGS OF FACT <br /> <br /> WHEREAS, the City of Santa Ana is a municipal corporation now <br />existing as such by virtue of a charter granted under the laws of the <br />State of California; and <br /> <br /> WHEREAS, the California Government Code Section 25643 provides <br />that the Board of Supervisors shall except from the levy of any tax <br />for structural fire protection all property within a city petitioning <br />therefor where the petition is supported by a resolution adopted by the <br />City Council which makes certain findings; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br /> City of Santa Ana hereby finds and declares that Santa Ana is an in- <br /> corporated City which has in operation and existence an organized Fire <br /> Department that, at the time of adoption of this Resolution, and for <br /> many decades last past, has been adequately staffed by competent, well- <br /> trained personnel under outstanding leadership, equipped with modern <br /> fire fighting equipment of all necessary kinds, and sufficiently sup- <br /> plied with fire fighting chemicals, which said Department has access <br /> to the Santa Ana water system maintained at high pressure; that the <br />excellence and adequacy of said Fire Department, its equipment, chem- <br /> icals, and personnel and the water system of the City, including the <br /> reservoirs and mains and the pressure of the water supply for fire <br /> fighting purposes, have been determined by the Insurance Services <br /> Offices, Committee on Fire Prevention and Engineering Standards, to <br /> be among the best in the State of California and the best in Orange <br /> County, California, so that Santa Ana now has the lowest fire insur- <br /> ance premium rate existing anywhere in this area; that Santa Ana is <br /> now providing adequate structural fire protection to all property <br /> within the incorporated limits of the City and that no additional <br /> benefit in fire protection is or would be received or required by <br /> such property from structural fire protection given by the County of <br /> Orange. <br /> <br /> BE IT FURTHER RESOLVED: That the said City Council hereby auth- <br />orized and directs that a petition be presented to the Honorable Board <br />of Supervisors of Orange County, California, attached to and supported <br />by a certified copy of this Resolution, petitioning said Board to ex- <br />clude and except from the levy of any tax imposed by the County of <br />Orange for structural fire protection all property within the limits <br />of the City of Santa Ana, California, and Carl J. Thornton, City Manager, <br />is hereby authorized and directed to sign said Petition, a copy of which <br />is attached to this Resolution, and to present the original thereof, <br />together with a certified copy of this Resolution, to the said Board <br />of Supervisors on or before April 17, 1972. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Ana <br />at its regular meeting held on the 17th day of April, 1972. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br /> City Attorney <br /> <br />MAY OR <br /> <br /> <br />
