RESOLUTION 72-88 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF SANTA <br />ANA WAIVING OTHERWISE REQUIRED SIDEWALKS <br />AT FAY CIRCLE EAST OF WEST STREET PURSUANT <br />TO SANTA ANA MUNICIPAL CODE §33-47(g) <br /> <br /> WHEREAS, Mr. Gerald Welty of 4021 West Fay Circle would, if <br />special relief were not granted, be required to install sidewalks <br />in the front of his property at the above address pursuant to SAMC <br />~33-47; and <br /> <br /> WHEREAS, the above said property is located at the end of a <br />cul-de-sac, and that the properties adjoining Mr. Welty's are not <br />equipped with sidewalks; and <br /> <br /> WHEREAS, the underlying purpose of the above mentioned code <br />section is to assure that among other things pedestrian traffic <br />in any given neighborhood will be properly accommodated; and <br /> <br /> WHEREAS, a petition has not been filed with the City Council <br />for the formation of a special assessment district for sidewalk <br />improvements at or about the location of Mr. Welty's property; and <br /> <br /> WHEREAS, as before stated, sidewalks do not exist on other <br />properties at or about Mr. Welty's at the cul-de-sac at West Fay <br />Circle. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That pursuant to the authority <br />granted by Santa Ana Municipal Code ~33-47(g) the City Council here- <br />by designates 4021 West Fay Circle, Santa Ana, exempted from the re- <br />quirement of this section, which requires the installation of side- <br />walks. <br /> <br />PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its regular meeting held on the 21st day of <br /> August , 1972. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYOR <br /> <br /> <br />
