RESOLUTION NO. 72-93 <br />RESOLUTION CONFIRMING ASSESSMENT <br /> <br /> ASSESSMENT DISTRICT NO. 225 <br /> SANTA ANA, CALIFORNIA <br /> <br /> WHEREAS, the Superintendent of Streets of the City of <br />Santa Ana, State of California, did on the 30th day of August, <br />1972 file with the Clerk of the Council of the City of Santa Aha, <br />California an assessment to represent the cost and expenses of the <br />work and improvement done and made by GRIFFITH COMPANY, contractor, <br />pursuant to proceedings had and taken by the City Council of said <br />City of Santa Ana under and pursuant to Resolution of Intention <br />No. 71-83 passed and adopted on September 7, 1971; and <br /> <br /> WHEREAS, said Clerk, as appears from the affidavit on file <br />herein, has duly given notice by publication, posting and mailing <br />in the time, form and manner as provided by law, of the filing of <br />said assessment and of the time set for hearing thereon, which <br />time was fixed in said notices as September 18, 1972 at 7:30 o'clock <br />P.M. in the chambers of said City Council in the City Hall Annex, <br />located in the City of Santa Ana, california; and <br /> <br /> WHEREAS, said City Council has received evidence concern- <br />ing said assessment and the proper completion of the work and im- <br />provement for which the same was issued; and <br /> <br /> WHEREAS, the Director of Public Works has advised that, <br />because of a clerical error: <br /> <br /> 1. Assessment No. 86 was erroneously given credit for <br />existing improvements and that to correct said error, said <br />assessment should be increased from $451.19 to $507.91; <br /> <br /> 2. Assessment No. 188 was not given credit for existing <br />improvements and that said assessment should be reduced from <br />$484.81 to $446.27. <br /> <br /> WHEREAS, all objections filed in writing by interested <br />parties to said work and improvement, or to the correctness of the <br />assessment, the assessment diagram filed therewith, or to any other <br />act, determination or proceeding of the Superintendent of Streets <br />have been disposed of without further modification of said assessment; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Santa Aha, State of California, in regular session <br />assembled, that the assessment and assessment roll, now on file <br />in the office of the Clerk of the city Council, be modified by pen <br />interlineation as follows: <br /> <br />1. Increase Assessment No. 86 from $451.19 to $507.91; <br /> <br />2. Decrease Assessment No. 188 from $484.81 to $446.27; <br /> <br />$79,164.22; <br /> <br />Decrease the City contribution from $79,182.40 to <br /> <br /> 4. Increase the total assessment and the amount to <br />be assessed from $167,124.24 to $167,142.42. <br /> <br /> BE IT FURTHER RESOLVED that except as hereinbefore <br />modified, the said assessment and assessment diagram, and warrant <br />attached to said assessment, the proceedings leading up to the <br />same, and all acts and determinations of all officers of said <br />City of Santa Ana in relation thereto be, and the same hereby are <br /> <br />-1- <br /> <br /> <br />
