RESOLUTION NO. 72-115 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA GRANTING <br />APPEAL NO. 309 AND APPROVING MINOR <br />EXCEPTION NO. 72-21 <br /> <br /> BE IT RESOLVED: That, based upon the Findings of Fact <br />of the Planning Commission and testimony presented before <br />the City Council, the City Council of the City of Santa Ana <br />hereby grants Appeal No. 309 on Minor Exception No. 72-21 <br />filed by Lee HasenJaeger and John Conley to allow a cocktail <br />lounge in an existing shopping center within 300' of an R 4 <br />District located at 2370 D N. Tustin Avenue subject to the <br />following conditions: <br /> <br />That development be according to the approved <br />plot plan, except for minor modifications <br />approved by the Planning Department. <br /> <br />2. That all conditions of the Building and Fire <br /> Departments be met. <br /> <br />3. That there be no after-hours operation (between <br /> 2:00 A.M. and 6:00 A.M.). <br /> <br />That there be no gaming devices, such as pool <br />tables, pinball machines, motion picture booths, <br />etc. <br /> <br />5. That interior lighting of the establishment be <br /> in accordance with A.B.C. regulations. <br /> <br />6. That there be no conduct or entertainment allowed <br /> on the premises as prohibited by Ordinance NS-1047. <br /> <br />That the building and its use shall conform to <br />the regulations of Title 19, California Adminis- <br />trative Code (Public Safety) and the Uniform <br />Fire Code. <br /> <br />8. Plans of the building shall be submitted to the <br /> Fire Department for approval. <br /> <br /> <br />
