RESOLUTION NO. 73-9 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA, CALIFORNIA, FINDING AND DETERMINING THAT THE <br />PUBLIC CONVENIENCE AND NECESSITY REQUIRE CERTAIN <br />IMPROVEMENTS IN THE CITY OF SANTA ANA, CALIFORNIA, <br />IN ASSESSMENT DISTRICT NO. 215 (MAPLE/COLUMBINE); <br />AND FURTHER THAT THE "SPECIAL ASSESSMENT INVESTI- <br />GATION, LIMITATION AND MAJORITY PROTEST ACT OF <br />1931" SHALL NOT APPLY; AND DETERMINING THAT SUCH <br />PROJECT SHALL PROCEED UNDER THE TERMS AND PROVISIONS <br />OF THE "IMPROVEMENT ACT OF 1911". <br /> <br /> WHEREAS, a public hearing, for which reasonable notice has <br />been given by publication and posting has been held as to the <br />public convenience and necessity for the construction of certain <br />street improvements and appurtenances in the City of Santa Ana, <br />California, in ASSESSMENT DISTRICT NO. 215 (MAPLE/COLUMBINE); and, <br /> <br /> WHEREAS, this City Council has heard and considered all the <br />evidence both oral and written relative to the public convenience <br />and necessity of the construction of the aforesaid improvement; <br />and, <br /> <br /> WHEREAS, this City Council now is satisfied as to the im- <br />provements and work as proposed. <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF <br />CITY OF SANTA ANA, CALIFORNIA, as follows: <br /> <br /> SECTION 1. That this City Council hereby finds and deter- <br />mines that the public convenience and necessity require the follOW- <br />ing work and improvement, to wit: <br /> <br />The construction of certain street improvements to- <br />gether with appurtenances and appurtenant work in <br />connection therewith in ASSESSMENT DISTRICT NO. 215 <br />(MAPLE/COLUMBINE), all as described in Resolution <br />of Intention No. 72-127. <br /> <br /> SECTION 2. This City Council further determines that the pro- <br />visions and limitations of the "Special Assessment Investigation, <br />Limitation and Majority Protest Act of 1931" shall not be applicable <br />to proceedings for this improvement. <br /> <br /> SECTION 3. That this project for improvements and acquisition <br />shall proceed in accordance with the terms and provisions of the <br />"Improvement Act of 1911", being Division 7 of the Streets and <br />Highways Code and that bonds, for purposes of financing said pro- <br />ject, shall be issued in accordance with the terms and provisions <br />of said Act <br /> <br />APPROVED and ADOPTED this <br /> <br />ATTEST: <br /> <br />CITY CLERK AND CLERK OF THE <br />COUNCIL OF THE CITY OF SANTA <br />ANA, CALIFORNIA <br /> <br />day of February, 1973 <br /> <br />MAYOR OF THE CITY OF SANTA ANA, <br />CALIFORNIA <br /> <br /> <br />
