RESOLUTION NO. 73-24 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA UPHOLDING THE <br />DECISION OF THE ZONING ADMINISTRATOR <br />AND APPROVING MINOR EXCEPTION NO. 73-3 <br />FILED BY DIETRICH REICH <br /> <br /> BE IT RESOLVED: That based upon the finding of fact of <br />the Zoning Administrator, the City Council of the City of Santa <br />Ana does hereby grant Minor Exception 73-3 filed by Dietrich <br />Reich to allow a restaurant with on sale liquor within 300' <br />of residentially zoned property subject to the following condi- <br />tions: <br /> <br />That development be according to the approved <br />plot plan, except for minor modifications <br />approved by the Planning Department. <br /> <br />That all conditions of the Building and Fire <br />Departments be met. <br /> <br />That a landscape plan be submitted to and <br />approved by the Planning Department, including <br />the provisions of Sec. 41-618 of the Zoning <br />ordinance, and that said landscaping be imple- <br />mented and be continuously maintained. <br /> <br />That the business remain a bona fide eating <br />establishment as defined by the Alcoholic <br />Beverage Control. <br /> <br />That there be no gaming devices, such as pool <br />tables, pinball machines, motion picture booths, <br />etc. <br /> <br />That interior lighting of the establishment be <br />in accordance with A.B.C. regulations. <br /> <br />That there be no conduct or entertainment allowed <br />on the premises as prohibited by Ordinance NS-1047. <br /> <br />That the use be approved for a period not exceeding <br />six (6) months, at which time staff will report to <br />the Planning Commission for revocation of the con- <br />ditional use permit should any of the conditions <br />be in violation. <br /> <br />9. Pay City water main charges. <br /> <br />10. Pay water service connection charges. <br /> <br />11. Pay street lighting deposit for future street lights. <br /> <br />12. <br /> <br />The applicant should be advised that curbside park- <br />ing on Seventeenth Street and Fairview Street will <br />not be permitted at the subject location at some <br />time in the near future. <br /> <br />-1- <br /> <br /> <br />
