<br />ESTABLISHING UNDERGROUND
<br />UTILITY DISTRICT NO. 4
<br />
<br /> WHEREAS, by Minute Order dated March 12, 1973, a public hearing was
<br />called for April 2, 1973, at the hour of 7:30 P.M., at the Council Chambers
<br />of the City Hall, 22 Civic Center Plaza, Santa Ana, California, to ascertain
<br />whether the public necessity, health, safety, or welfare requires the re,oval
<br />of poles, overhead wires and associated overhead structures, and the udder-
<br />ground installatic~ of wires and facilities for supplying electric cuL,,,uni-
<br />catio~ or similar or associated service, within that certain area of the City
<br />described as follows for the formatic~ of the Underground Utility District No.
<br />4: That strip of land measuring 70 feet wide frcm the center line to each
<br />side of Seventeenth Street between Ross Street and approximately 191 feet west
<br />of Main Street as shown on attached Exhibit "A"; and
<br />
<br /> WHEREAS, notice of such hearing has been given to all affected property
<br />owners as such ere shown on the last equalized assessment roll and to all
<br />utilities concerned in the manner and within the time re~ red by law; and
<br />
<br /> WHEREAS, such hearing has been duly add regularly held, and all persons
<br />interested have been given an opportunity to he heard.

<br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa
<br />Aha: That pursuant to Santa Ana Municipal Code Sections 37-1 to 37-13, the
<br />above-described area is hereby declared an Underground Utility District, and
<br />is designated as Underground Utility District No. 4 of the City of Santa Ana.
<br />Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this
<br />Resolution, is amp delineating the boundaries of said District;
<br />
<br /> BE IT FD~'HER RESOLVED: That the City Council does hereby fix April 15,
<br />1974, as the date on which affected property owners mst he ready to receive
<br />underground service, and does hereby order the r~moval of all poles, overhead
<br />wires and associated overhead structures and the underground installation of
<br />wires and facilities for supplying electric, cu~,,L~nication, or similar or assoc-
<br />iated service within Underground Utility District No. 4 on or before June 1, 1974.

<br /> BE IT FURTHER RESOLVED: That the Clerk of the Council is hereby instruct-
<br />ed to notify all affected utilities add all persons owning real property within
<br />U~derground Utility District No. 4 of the adoption of this Resolution within ten
<br />(10) days after the date of such adoption. Said Clerk of the Council shall
<br />further notify said property owners of the necessity that, if they or any person
<br />occupying such property desire to continue to receive electric, ccm~mication or
<br />other similar or associated service, they or such occupant shall, by the date
<br />fixed in this Resolution, provide all necessary facility changes on their premises
<br />so as to receive such service frcm the lines of the supplying utility or utilities
<br />at a new location, subject to applicable rules, regulations and tariffs of the
<br />respective utility or utilities on file with the Public Utilities Cu~,~ssion of
<br />the State of California. Such notification shell he made by mailing a copy of
<br />this Resolution, together with a copy of said Santa Ana Municipal Code Sections
<br />37-1 to 37-13 to all affected property owners as such ere shown on the last
<br />equalized asses~_nt roll and to the affected utilities;

<br /> BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana
<br />hereby fiDds and determines as follows:
<br />
<br /> The Underground Utility District herein created is in the general public
<br />interest for the following reason: The undergrounding to he accc~plished will
<br />avoid or eliminate an unus,~lly heavy concentration of overhead distribution
<br />facilities.
