RESOLUTION NO. 73-61 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA UPHOLDING THE DECISION OF THE PLANNING <br />COMMISSION OF THE CITY OF SANTA ANA AND APPROVING <br />VARIANCE NO. 73-6 FILED BY H AND J MABURY COMPANY <br /> <br /> BE IT RESOLVED: That based upon the findings of fact <br />of the Planning Commission of the City of Santa Ana, the <br />City Council of the City of Santa Ana does hereby grant <br />Variance 73-6 filed by H and J Mabury Company to construct <br />a 290 unit garden complex at 1350 North Cabrillo Park Drive <br />in the R-4 and R-1 district subject to the following condi- <br />tions: <br /> <br /> 1. That the following standard conditions of approval <br />must be met: <br /> <br />A. Planning: <br /> <br />1. That all conditions of the Building Department be met. <br /> <br />That a landscape plan be submitted to and approved by <br />the Planning Department, including the provisions of <br />Sec. 41-618 of the Zoning Ordinance (prior to issuance <br />of a building permit) and that said landscaping be <br />implemented (prior to utility release) and be contin- <br />uously maintained. <br /> <br />3. That any trash areas be enclosed in accordance with <br /> the Planning Department standards. <br /> <br />4. That there be a minimum 15 feet between main dwellings, <br /> clear of balconies, landings or stairways. <br /> <br />That an Environmental Impact Report be prepared, sub- <br />mitted and approved by all departments, commissions, <br />boards and/or agencies prior to the issuance of <br />building permits. <br /> <br />That a screening plan for mechanical equipment or <br />appurtenances be submitted to and approved by the <br />Planning Department. <br /> <br />7. That all conditions of the Fire Department be met. <br /> <br />B. PUBLIC WORKS <br /> <br />Submit to the Department of Public Works, for their <br />approval, an acceptable final grading plan or an on-site <br />drainage plan, or both, showing the direction and means <br />of flow to the adjacent street(s) or channel(s) when <br />this property is developed. Plan is to include existing <br />and proposed elevations at the property lines. Appli- <br />cants should check with the Department of Public Works <br />for extent of study needs. <br /> <br />2. Dedicate required street or alley right of way. <br /> <br /> <br />
