RESOLUTION NO. 73-67 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DECLARING THAT AN URGENT NECESSITY RE- <br />QUIRES THAT CONTRACTS FOR THE PURCHASE OF GASOLINE <br />FOR THE FISCAL YEAR BEGINNING JULY 1, 1973 BE LET <br />WITHOUT ADVERTISING FOR BIDS AND AUTHORIZING THE <br />CITY MANAGER TO EXECUTE SUCH CONTRACTS ON BEHALF <br />OF THE CITY <br /> <br /> WHEREAS, the City of Santa Ana by contract is currently <br />supplied with gasoline for city Fire Department vehicles by <br />the Standard Oil Company of California and for all other <br />vehicles including police vehicles by the Shell Oil Company, <br />and <br /> <br /> WHEREAS, in anticipation of the expiration of these <br />contracts on June 30, 1973 the City advertised in May of <br />1973 for competitive bids for gasoline contracts for the <br />year beginning July 1, 1973 as required by Section 421 of <br />the City Charter, and <br /> <br /> WHEREAS, no bids whatsoever were offered for Fiscal <br />Year 1974 and the City has been informed by potential suppliers <br />that no bids will be made in view of the general national in- <br />dustry-wide shortage of gasoline and other fuels, and <br /> <br /> WHEREAS, the Federal Government is expected to require <br />suppliers of gasoline to governmental agencies in Fiscal <br />Year 1973 to offer to supply such agencies with at least <br />equivalent amounts of fuel for Fiscal Year 1974, and <br /> <br /> WHEREAS, the Standard Oil Company of California has <br />offered to contract with the City to supply up to 26,000 <br />gallons of premium gasoline for the year beginning July 1, <br />1973 at a fair bulk market price for use by the Fire Depart- <br />ment and the Shell Oil Company has offered to contract with <br />the City to supply up to 300,000 gallons of premium gasoline <br />and up to 100,000 gallons of regular gasoline at a fair bulk <br />market price for use by other city agencies, and <br /> <br /> WHEREAS, the City Council has been advised by the City <br />Manager and agrees that these contract offers are the only <br />available sources for guaranteed fuel delivery for Fiscal <br />Year 1974 in view of the current and anticipated general fuel <br />shortage, that no other potential suppliers will offer to <br />supply the City's requirements and that under the circumstances <br />of the national fuel shortage the terms and conditions of the <br />offered contracts are reasonable and the best that can be <br />obtained, and <br /> <br /> WHEREAS, the life, health and property of the citizens of <br />Santa Ana will be seriously endangered if the Fire Department, <br />Police Department and other city departments and agencies are <br />not guaranteed a continuing supply of fuel from and after <br />July 1, 1973 to operate fire and police vehicles and other <br />vehicles and equipment, <br /> <br /> NOW, THEREFORE BE IT RESOLVED, that the City Council of <br />the City of Santa Ana finds and declares that it is impossible <br />under the circumstances of the current and anticipated <br /> <br /> <br />
