Recorded October 25, 1973 <br />9:05 A.M. <br />Bk 10960 l°g 988 <br /> <br />RESOLUTION NO. 73-110 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ORDERING THE VACATION <br />OF ALLEY ON THE EAST SIDE OF HATHAWAY <br />RESERVING AN EASEMENT THEREIN FOR THE <br />CITY OF SAI~TA ANA <br /> <br /> WHEREAS, on recommendation of the Department of Public Works <br />and the Planning Commission of the City of Santa Ana, The City <br />Council of the City of Santa Ana adopted Resolution No. 73-106, <br />giving notice of intention to vacate an alley on the east side <br />of Hathaway; and <br /> <br /> WHEREAS, Resolution No. 73-106 was published, and notice <br />of intention to vacate was posted as required by law; and <br /> <br /> WHEREAS, on October 1, 1973, a public hearing was duly <br />held on said vacation; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby finds that the above named alley <br />is no longer necessary for present or prospective street pur- <br />poses, and does hereby make its order to vacate said right <br />of way. Said right of way lies in the City of Santa Ana, <br />County of Orange, State of California, described as follows: <br /> <br />That certain alley in Tract No. 4450 in the City <br />of Santa Ana, County of Orange, State of California <br />as shown on a map recorded in Book 157, Pages 15 <br />and 16 in the office of the County Recorder of said <br />County. The Westerly terminus of said alley being <br />the continuation of the right of way line of the <br />cul-de-sac having a 50.00 foot radius at the end of <br />Hathaway Street. <br /> <br />Excepting therefrom an easement for water mains over <br />that portion of said alley as shown on a deed to <br />the City of Santa Ana recorded in Book 10272, Pages <br />987 and 989 in the Office of the County Recorder of <br />said County. <br /> <br />BE IT FURTHER RESOLVED: That the public convenience <br />and necessity require the reservation of an easement over said <br />right of way for the City of Santa Ana for water main purposes. <br /> <br /> BE IT FURTHER RESOLVED: That these proceedings are taken <br />subject to said easement over said right of way for the City <br />of Santa Ana for water main purposes. <br /> <br /> PASSED AND ADOPTED by the City Council of the City <br />of Santa Ana at its regular meeting held on the <br />day of October , 1973. <br /> <br />ATTEST: <br /> <br />CLERK OF COUNCIL <br /> <br /> <br />
