RESOLUTION 73-128 <br />OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />GRANTING TO SOUTHERN PACIFIC TRANSPORATION <br />COMPANY, A CORPORATION, ITS SUCCESSORS AND <br />ASSIGNS, A PERMIT TO CONSTRUCT, MAINTAIN AND <br />OPERATE A DRILL TRACK ACROSS YALE STREET SOUTH <br />OF SEGERSTROM AVENUE IN THE CITY OF SANTA ANA. <br /> <br /> WHEREAS, Southern Pacific Transporation Company, a corporation, <br />has applied for a permit to construct, maintain and operate its standard <br />gauge single spur track across Yale Street south of Segerstrom Avenue in <br />the City of Santa Aha, the center line of which is described on the attached <br />description marked Exhibit "A" and incorporated herein by reference. <br /> <br /> Reference is hereby made to the application of Southern Pacific <br />Transportation Company fo~ said permit now on file in the City of Santa <br />Ana, and incorporated herein as if fully set forth. <br /> <br />NOW, THEREFORE, BE IT RESOLVED as follows: <br /> <br /> SECTION 1. A permit is hereby granted to Southern Pacific Trans- <br />portation Company, a corporation, its successors and assigns, to construct, <br />maintain and operate a standard guage single spur track across Yale Street <br />south of Segerstrom Avenue as more particularly described in Exhibit "A" <br />attached hereto and incorporated herein. <br /> <br /> SECTION 2. This permit is specifically made subject to, and con- <br />ditioned upon, the approval of the City Engineer as to the agreed upon de- <br />tailed plans and specifications relating to said crossing. <br /> <br /> SECTION 3. Southern Pacific Transportation Company shall pay all <br />costs for improving said grade crossing including any crossing protection <br />as may be ordered by the State of California Public Utilities Commission, <br />either now or in the future. <br /> <br /> SECTION 4.
