~TATE OF CALIFORNIA RONALD REAGAN, Governor <br /> <br />DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT <br /> <br />December 4, 1973 <br /> <br />Gentlemen: <br /> <br />The enclosed State Relocation Guidelines were adopted by the California <br />Commission of Housing and Community Development on October 17, 1973, under the <br />legislative mandate contained in AB 1040 of the 1972 Legislative Session. The <br />guidelines closely parallel and are consistent with the guidelines developed <br />by the Federal Office of Management and Budget pursuant to Public Law 91-646 <br />(Uniform Relocation Assistance and Land Acquisition Policies of 1970). <br /> <br />The guidelines are intended to establish a statewide uniform relocation policy <br />and, as such, provide a consistent context for local interpretation of specific <br />cases. State Relocation Law and guidelines are applicable in all instances of <br />displacement caused by public agencies to achieve public use. <br /> <br />For your convenience the following items are included in this transmittal: <br /> <br />1. State Relocation Assistance Law - AB 533, Chapter 16, Sections 7260 <br /> et. seq. California Health and Safety Code. <br /> <br />State Relocation Guidelines - Pursuant to AB 1040, Chapter 1307 <br />California Government Code and Sections 37042 and 37109.5, California <br />Health and Safety Code. <br /> <br />3. "In the Path of Progress" - Yale Law Journal, Volume 82, Number 2, <br /> December 1972. This article documents basic relocation issuesJ <br /> <br />The date by which local jurisdictions must adopt the enclosed State Guidelines <br />is March 7, 1974. <br /> <br />The Department of Housing and Community Development will provide assistance <br />and consultation to assure adequate completion of this task.
