RESOLUTION NO. 74-10 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA SUPPORTING THE ENACTMENT OF FEDERAL <br />LEGISLATION TO NULLIFY THE RECENT PARKING AND <br />CARPOOL REGULATIONS OF THE ENVIRONMENTAL PROTEC- <br />TION AGENCY AND POSTPONING FURTHER REGULATIONS <br />UNTIL CONGRESS HAS STUDIED THEIR IMPACT AND <br />ALTERNATIVES. <br /> <br /> W~EREAS, the City Council of the City of Santa Ana <br />vigourously supports the objectives of the 1970 Clean Air <br />Act and all efforts to implement such objectives towards <br />cleaning up the environment; and <br /> <br />WHEREAS, the federal Environmental Protection Agency <br />(EPA) promulgated certain regulations on November 12, 1973, <br />entitled the California Transportation Control Plan; and <br /> <br /> WHEREAS, the California Transportation Control Plan <br />contains within its provisions regulations which would create <br />and impose both economic and administrative chaos in and <br />upon the public and private come, unities of the City of Santa <br />Ana and elsewhere in the State of California; and <br /> <br /> WHEREAS, the City of Santa Ana, along with 180 other <br />petitioners in the State of California, including 8 counties <br />and 67 other cities, has filed with the federal Court of <br />Appeals for the Ninth Circuit Petitions for Review, which <br />petitions challenge both the constitutional as well as sta- <br />tutory authority for said EPA regulations; and <br /> <br /> WHEREAS, EPA claims and purports to be acting pursuant <br />to authority it claims to have been granted by the provisions <br />of the federal "Clean Air Act" (42 USCA Sections 1856 et seq.); <br />and <br /> <br /> WI~EREAS, <br />Review could <br />litigate and <br /> <br />the legal issues raised by said Petitions for <br />take several months and be extremely costly to <br />finally resolve in the courts; and <br /> <br /> WHEREAS, as a matter of constitutional law, economic <br />necessity and practical expediency, said legal issues can and <br />should be resolved quickly by the immediate nullification of <br />the parking surcharge, the management of parking supply and <br />the preferential bus/carpool lanes provisions of EPA's Califor- <br />nia Transportation Control Plan; and <br /> <br /> WHEREAS, the City of Santa Ana is seeking ways and means <br />of improving the quality of its total environment, which ways <br />and means will include consideration of the social and economic <br />impact of its policies upon the residents, the businesses and <br />the industries of the community. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana hereby approves, endorses and urges the <br />immediate enactment of federal legislation in the language and <br />form as that contained in Section 202(c) of the former Senate <br />Bill S2589 of the 1973 session of Congress at the earliest date <br />practicable after Congress convenes in 1974. <br /> <br /> <br />
