SECTION 4. <br /> <br />SECTION 5. <br /> <br />Planning Commission or the Santa Ana City Council, <br />according to its rules, regulations, and ordinances, <br />Legislative action in regard to a project constitutes <br />approval. <br /> <br /> In connection with private activities, <br /> <br />approval occurs upon the earliest commitment to <br />issue or the issuance by the City of a discre- <br />tionary contract, grant, subsidy, l'oan or other <br />form of financial assistance, lease, permit, <br />license, certificate, or other entitlement for <br />use of the project. <br /> <br />CEQA California Environmental Quality Act. CEQA <br />means the Environmental Quality Act of the State <br />of California and in particular, California Public <br />Resources Code §§ 21000 - 21174. <br /> <br />Categorical Exemption. Categorical exemption means <br />an exception from the requirement~ feF-~he-prepa~a- <br />~en-ef-a~-E~v+~enme~a~-~mpee~-Re~e~-fe~-a-e~ass-ef <br />p~e}e~s of the CEQA based on a finding by the Environmental <br />Impact Evaluator or the Environmental Review Commit- <br />tee of the City of Santa Ana, theft th~ project comes <br />within ~hos'~ classes of pscjects determined by the <br />Sec'ret~ry~,of the, California State Resources Agency, <br />~ha~he-pa~+e~aP-p~e~ee~-dees a~s not have havin~ <br />a significant effect on the environment, which classes <br />of projects are se~ forth in Article III, § 3 herein. <br /> <br />-4- <br /> <br /> <br />
