STATE OF CALIFORNIA <br />GUIDELINES FOR ISSUANCE OF REGULATIONS & PROCEDURES <br />IMPLEMENTING THE RELOCATION ASSISTANCE LAW <br />~OVERNMENT CODE, CHAPTER 16, SECTIONS 7260'et.seq. <br /> <br />~--G~E~L <br /> <br />.Purpose and coverage. <br /> <br /> a. These guidelines are to assist public entities in the <br />development of regulations and procedures implementing Chapter t6, <br />Sections 7260 et. seq. of the Government Code, Relocation Assis- <br />tance, hereinafter referred to as the Act, to assure a uniform <br />policy for the fair and equitable treatment of persons displaced <br />by programs of public entities. All references in these Guidelines <br />to sections or subsections are references to sections or subsections <br />of the Act. ~ <br /> <br /> b. In the event of any conflict between these guidelines and <br />the provisions of the Act, or any other applicable law, the statu- <br />tory provisigns are controlling. <br /> <br /> c. It is the intent of the guidelines tO establish minimum <br />requirements for relocation assistance payments by public entities. <br />These guidelines shall not be construed to limit any other authority <br />which a public entity may have to make other relocation assistance <br />paYments, or to make any relocation assistance payment in an amount <br />which exceeds the maximum amount for such payment authorized by this <br />chapter. <br /> <br /> d. Any public entity may, also, make any other relocation assis- <br />tance payment, or may make any relocation assistance payment in an amount <br />which exceeds the maximum amount for such payment authorized by <br />these guidelines, if the making of such payment, or the payment in <br />such amount, is required under, federal law. to secure federal funds. <br /> <br />1.2 General considerations. <br /> <br /> a. In developing regulations and procedures under <br />these Guidelines, agencies should consider: <br /> <br />the Act and <br /> <br /> (1) House Report No. 91-1656 of December 2, 1970, A Report <br />to accompany S.l,.Committee on Public Works, House of Representatives, <br />91st Congress, 2nd Session.~ ~ <br /> <br /> (2) Provisions of other applicable law, including Title VI <br />of the Civil Rights Act o~ ~964, and Title VIII of the Civil Rights <br />Act of 1968. <br /> <br />(3) Applicable state laws and good faith and reasonableness. <br /> <br />II- 2 <br /> <br /> <br />
