RESOLUTION NO. 75-33 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, REQUESTING CONCURRENCE AND CONSENT OF THE SOUTHWESTERN MUTUAL WATER COMPANY TO THE FORMATION OF A SPECIAL ASSESS- MENT DISTRICT AND THE INSTALLING OF WATER LINES WITHIN THE BOUNDARIES OF THE SOUTHWESTERN MUTUAL WATER COMPANY WHEREAS, the City Council of the City of Santa Ana California is considering the formation of a special assessment district for the purposes of installing certain water lines together with appurtenances and appurtenant work in an area designated as ASSESSMENT DISTRICT NO. 239, said area also being generally the boundaries of the Southwestern Mutual Water Company; and WHEREAS, said proceedings are to be pursuant to the terms and provisions of the "Municipal Improvement Act of 1913," being Division 12 of the Streets and Highways Code of the State of California, and to be financed through bonds to issue pursuant to the terms and provisions of the "Improvement Act of 1911", being Division 7 of said Code; and WHEREAS, this City Council is desirous at this time to receive the concurrence and approval from the Board of Directors of the South- western Mutual Water Company to the formation of the assessment district, the installing of the lines and the servicing of the properties within the boundaries of the assessment district, said properties also being within the boundaries of the Southwestern Mutual Water Company. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That this City Council hereby requests the concur- rence and consent from the Board of Directors of the Southwestern Mutual Water Company of the following: a. Formation of the special assessment district. b. Authority to assess benefitted properties. c. To serve the parcels and properties within the boundaries of the assessment district, all being within the boundaries of the Southwestern Mutual Water Company. d. Acknowledge that there be no liability or re- sponsibility by reason of said improvements and service by the City of Santa Aha. e. Waiver of any rights or actions that the South- western Mutual Water Company may have by reason of the City of Santa Ana conducting the proceed- ings, installing the lines, and servicing the properties within the boundaries of the assessment district. SECTION 3. A certified and conformed copy of this Resolution should immediately be transmitted by the Clerk to the Board of Directors of the Southwestern Mutual Water Company, requesting that action be taken by said Southwestern Mutual Water Company at the next most con- venient meeting.
