RESOLUTION NO. 75-59 <br /> <br />CITY OF SANTA ANA, CALIFORNIA <br /> <br />RESOLUTION OF THE CITY COUNCIL CONFIRMING <br />ASSESSMENT PURSUANT TO "IMPROVEMENT ACT OF <br />1911," BEING DIVISION 7 OF THE STREETS AND <br />HIGHWAYS CODE OF THE STATE OF CALIFORNIA <br /> <br />ASSESSMENT DISTRICT NO. 237 <br /> (QUIGLEY LANE) <br /> <br /> WHEREAS, there has been filed with the City Clerk an assess- <br />ment to represent the costs and expenses of the work and improvement <br />done pursuant to proceedings had and taken under the provisions of the <br />"Improvement Act of 1911," being Division 7 of the Streets and Highways <br />Code of the State of California, and pursuant to Resolution of Intention <br />No. 74-168; and, <br /> <br /> WHEREAS, the City Clerk has duly given notice in the manner <br />provided by law of the filing of said assessment and of the time set <br />for hearing; and, <br /> <br /> WHEREAS, said City Council is now satisfied as to the proper <br />completion of the work and of the spreading of the assessment. <br /> <br /> NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA, CALIFORNIA, AS FOLLOWS: <br /> <br />SECTION 1. That the above recitals are all true and correct. <br /> <br /> SECTION 2. That the assessment and diagram, the proceedings <br />leading up to the same, and all acts and determinations of the officers <br />and agents of the City of Santa Ana, California, in relation to the <br />work done and appurtenances and appurtenant work in: <br /> ASSESSMENT DISTRICT NO. 237 <br /> (QUIGLEY LANE) <br />and to the said assessment, and the diagram attached thereto be, and <br />the same are hereby ratified and confirmed, the work and improvement is <br />accepted, and the Superintendent of Streets is hereby ordered and <br />directed to attach to said assessment a warrant in the manner and form <br />provided by law, said warrant bearing date of this Resolution, and is <br />further ordered to deliver said warrant, diagram and assessment to the <br />contractor or its assignee, as the case may be, forthwith upon payment <br />of the incidental expenses due thereon. <br /> <br /> SECTION 3. That the assessment roll, warrant and diagram <br />shall be recorded in the office of the Superintendent of Streets and <br />immediately thereafter, the City Clerk shall file a copy of the assess- <br />ment diagram in the office of the County Recorder and thereafter shall <br />record in said office of the County Recorder a Notice of Assessment, <br />all in the manner and form as prescribed by Section 3114 of the Streets <br />and Highways Code of the State of California. <br /> <br />APPROVED and ADOPTED this 5th day of May <br /> <br />, 1975. <br /> <br />ATTEST: <br /> <br /> ~O~ENCEI.~AU~NE <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
