CJL:~O <br /> <br />RESOLUTION NO. 75-81 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING MAP AND <br />DECLARING INTENTION TO VACATE A PORTION <br />OF HAZARD AVENUE WEST OF HARBOR BOULEVARD <br />AND RESERVING AN EASEMENT FOR UTILITY <br />PURPOSES <br /> <br /> WHEREAS, the Department of Public Works and the <br />Planning Commission have recommended a public hearing be set on <br />the question of said vacation a request for the vacation of <br />a portion of Hazard Avenue west of Harbor Boulevard; and <br /> <br /> WHEREAS, the Department of Public Works has deemed <br />it essential to the health, safety and welfare that an easement <br />be retained over said right of way for The Pacific Telephone and <br />Telegraph Company for utility purposes; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City of <br />Santa Ana hereby approves the map attached hereto and orders <br />the same filed with the original of this resolution in the <br />office of the Clerk of the Council, and reference is hereby made <br />to said map for the exterior boundaries for said right of way <br />proposed to be abandoned. <br /> <br /> The City Council declares its intention to proceed <br />under the provisions of the Street Vacation Act of 1941 (~8300- <br />8374 of the California Streets and Highways Code) to abandon <br />a portion of Hazard Avenue west of Harbor Boulevard in the City <br />of Santa Ana, County of Orange, State of California, described <br />as follows: <br /> <br />A strip of land 2.00 feet in width, being a <br />portion of the North half of the Northeast <br />quarter of the Southeast quarter of Section <br />9, Township 5 South, Range 10 West, in the <br />Rancho Las Bolsas, in the City of Santa Ana, <br />County of Orange, State of California as per <br />map recorded in Book 51, Page 12 of Miscell- <br />aneous Maps, in the Office of the County <br />Recorder of said County, being more particu- <br />larly described as follows: <br /> <br />The South 2.00 feet of Hazard Avenue adjoining <br />the North lines of Parcel 4 and of Parcel 3 <br />as shown on a map filed in Book 54, Page 31 of <br />Parcel Maps, Records of said Orange County. <br /> <br />Reserving an easement over the above-mentioned <br />strip of land to construct, place operate, <br />inspect, maintain, repair, replace, and remove <br />such aerial and underground telephone, tele- <br />graph and communication structures as The <br />Pacific Telephone and Telegraph Company <br />may, from time to time, require, consisting <br />of poles, anchors, wires, cables, conduits, <br />manholes, markers, and necessary fixtures <br />and appurtenances. <br /> <br /> BE IT FURTHER RESOLVED that the public convenience <br />and necessity require the reservation of an exclusive permanent <br />easement over a portion of said right of way by The Pacific <br />Telephone and Telegraph Company for utility purposes. <br /> <br /> <br />
