CJL: po <br />6-11-75 <br /> <br />RESOLUTION NO. 75-82 <br /> <br />A RESOLUTION OF THE CITY CO~CIL OF THE <br />CITY OF SANTA ANA APPROVING MAP AND <br />DECLARING INTENTION TO VACATE AN EAST-WEST <br />ALLEY BETWEEN FOURTH AND FIFTH STREETS AND <br />FRENCH AND MORTIMER STREETS, AND RESERVING <br />AN EASEMENT FOR UTILITY PURPOSES <br /> <br /> WHEREAS, the Department of Public Works and the <br />Planning Commission have recommended a public hearing be set <br />on the question of said vacation, a request for the vacation <br />of an east-west alley between Fourth and Fifth Streets and <br />French and Mortimer Streets; and <br /> <br /> WHEREAS, the Department of Public Works has deemed <br />it essential to the health, safety and welfare that an ease- <br />ment be retained over said right of way for the Southern <br />Counties Gas Company for utility purposes; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City of <br />Santa Ana hereby approves the map attached hereto and orders <br />the same filed with the original of this resolution in the <br />office of the Clerk of the Council, and reference is hereby <br />made to said map for the exterior boundaries for said right <br />of way proposed to be abandoned. <br /> <br /> The City Council declares its intention to proceed <br />under the provisions of the Street Vacation Act of 1941 <br />(~§8300-8374 of the California Streets and Highways Code) <br />to abandon an east-west alley between Fourth and Fifth Streets <br />and French and Mortimer Streets in the City of Santa Ana, <br />County of Orange, State of California, described as follows: <br /> <br />Those portions of Lots 1 thru 10 in Block 4 <br />of Fruits' Addition to Santa Ana, as shown <br />on a Map recorded in Book 9, page 91 of <br />Miscellaneous Records of Los Angeles County, <br />California, described as follows: <br /> <br />Beginning at a point in the West line of said <br />Lot 1 distant Southerly thereon 7.00 feet from <br />the Northwest corner thereof; thence Easterly <br />parallel with the North line of said Lot 1 a <br />distance of 50.00 feet to the East line thereof; <br />thence Southerly thereon 1.00 foot; thence <br />Easterly parallel with the North lines of said <br />Lots 2 through 5 a distance of 200.00 feet to <br />the East line of said Lot 5; thence Northerly <br />along the East lines of said Lots 5 and 6 a <br />distance of 12.00 feet; thence Westerly parallel <br />with the South lines of said Lots 6 through 10 <br />to a distance of 250.00 feet to the West line <br />of said Lot 10; thence Southerly along the West <br />lines of said Lots 1 and 10 a distance of 11.00 <br />feet to the point of beginning. <br /> <br />Reserving an easement over the above-described <br />land to construct, place, operate, inspect, <br />maintain, repair, replace, remove, and enlarge <br />lines of pipe and other structures, equipment and <br />fixtures for the operation of gas lines as the <br />Southern Counties Gas Company may, from time to <br />time require. <br /> <br /> <br />
