RESOLUTION NO. 75- 173 <br />Page Two <br /> <br /> SECTION 2: Pursuant to and in accordance with the <br />provisions of Part 3 of Division 9 of the Streets and Highways <br />Code of the State of California, this Council does hereby <br />order the vacation of that portion of Sixth Street between Ross <br />Street and Santa Ana Boulevard subject to the reservation and <br />exception of the easement and right of way hereinafter described: <br /> <br />Reserving and excepting to the City of Santa Ana <br />the permanent easement and right at any time, <br />or from time to time, to construct, maintain, <br />operate, replace, remove, and renew sanitary <br />sewers and storm drains and appurtenant structures <br />in, upon over and across any street or part <br />thereof proposed to be vacated and pursuant to <br />any existing franchises or renewals thereof, or <br />otherwise, to construct, maintain, operate, <br />replace, remove, renew and enlarge lines of <br />pipe, conduits, cables, wires, poles, and other <br />convenient structures, equipment and fixtures <br />for the operation of gas pipe lines, telegraphic <br />and telephone lines, railroad lines, and for the <br />transportation or distribution of electric energy, <br />petroleum and its products, ammonia, water, <br />and incidental purposes, including access and the <br />right to keep the property free from inflammable <br />materials, and wood growth, and otherwise protect <br />the same from all hazards in, upon and over the <br />street or part thereof proposed to be vacated. <br /> <br /> SECTION 3: Pursuant to the provisions of Section 5079 <br />of the Public Resources Code of the State of California, this <br />Council does hereby find and determine that neither said portion(s) <br />of said street nor parts thereof is useful as bicycle paths or <br />routes. <br /> <br /> PASSED AND ADOPTED by the City Council of the <br />City of Santa Ana at its adjourned regular meeting held on the <br /> 8th day of December , 1975. <br /> <br />ATTEST: <br /> <br /> <br />
