KLG:rs <br />12-31-75 <br /> <br />RESOLUTION NO. 76-1 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA IN SUPPORT OF <br />HR-9801. <br /> <br /> WHEREAS, under present federal law, Congress has no <br />power to oversee administrative rule and regulation making <br />procedures and policies of the Executive Branch of the Federal <br />Government, and <br /> <br /> WHEREAS, in the opinion of this Council, the rule <br />and regulation making power of the Executive Branch of the <br />Federal Government has been exercised in the past, from time <br />to time, in a manner to thwart the intent of Congress and to <br />impose upon local elected officials duties, responsibilities <br />and other requirements that are more stringent than was in- <br />tended by Congress, and <br /> <br /> WHEREAS, the exercise of such powers by the Executive <br />Branch of the Federal Goverment has thereby usurped the decision <br />making authority of local elected officials and imposed unneces- <br />sary and unreasonable delays and complications upon the process <br />of carrying out federal programs. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana as follows: <br /> <br /> 1. That this Council does hereby support enactment <br />of HR-9801, which, if adopted, "may prevent the adoption <br />by the executive branch of rules or regulations which are <br />contrary to law or inconsistent with congressional intent or <br />which go beyond the mandate of the legislation which they are <br />designed to implement", and does hereby urge its passage. <br /> <br /> 2. The Clerk of the Council is directed to forward <br />copies of this Resolution to Senators Cranston and Tunney; <br />Congressman Peter W. Rodino, Jr., Chairman of the House <br />Judiciary Committee; Congressman Ray J. Madden, Chairman of <br />the House Rules Committee; members of the House of Representatives <br />who represent districts in Orange County; the League of California <br />Cities; and the County Supervisors Association of California. <br /> <br /> PASSED AND ADOPTED by the City Council of the City <br />of Santa Ana at its re§ular meeting held on the 5th <br />day of January , 1976. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA ) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br />ss. <br /> <br /> I, FLORENCE I.
