RESOLUTION NO. 76-34 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA EXPRESSING ITS <br />CONCERN REGARDING THE METHODS OF <br />OPERATION OF FAMILY CARE HOMES AND <br />GROUP HOMES IN THE CITY, AND URGING <br />THE LEGISLATURE TO AMEND THE STATUTES <br />APPLICABLE THERETO. <br /> <br /> WHEREAS, this Council has been informed that operators <br />of state-authorized, certified or licensed family care homes or <br />group homes serving six or fewer mentally disordered or other- <br />wise handicapped persons or dependent and neglected children <br />are operating facilities consisting of more than one adjacent <br />residential properties in the City; and <br /> <br /> WHEREAS, such facilities amount, in the opinion of this <br />Council, to single businesses, having common ownership, control, <br />and management, and often single kitchen locations; and <br /> <br /> WHEREAS, in the opinion of this Council such facilities <br />effectively evade the stated policy of the Legislature to dis- <br />burse patients of such homes in order to provide so far as <br />possible, normal residential surroundings to such patients, and <br />therefore, amount to a re-institutionalization of such patients <br />to the detriment of such patients, the neighborhoods in which <br />such facilities are located, and the City as a whole. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Ana, as follows: <br /> <br /> 1. That this Council expresses to the Legislature its <br />concern over the manner in which state-authorized, certified, <br />or licensed family care homes and group homes are allowed to <br />operate, as specified above. <br /> <br /> 2. That this Council does hereby urge the Legislature <br />to amend Section 5116 of the Welfare and Institutions Code, and <br />other law as deemed applicable by the Legislature, so as to re- <br />quire disbursement of such homes throughout residential neighbor- <br />hoods, and eliminate concentration thereof on adjacent parcels <br />of residential property. <br /> <br /> 3. That a sample draft of such amendment is attached <br />hereto as "Exhibit A" and is urged upon the Legislature for <br />adoption as a means to bring an end to the harmful concentra- <br />tions of such homes in the City. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its adjourned regular meeting held on the 22nd <br />day of March , 1976. <br /> <br />ATTEST: <br /> <br /> <br />
