WPM:n~ <br />3-18-76 <br /> <br />RESOLUTION NO. 76-35 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OPPOSING SENATE BILL <br />1500 CSONG) COURT REORGANIZATION <br /> <br /> WHEREAS, Senate Bill 1500 (Song) has been introduced <br />to the California State Senate; and <br /> <br /> WHEREAS, Senate Bill 1500 is presently before and <br />being considered by the Senate Conunittee on Judiciary; and <br /> <br /> WHEREAS, Chairman of the Senate Committee on Judiciary, <br />Senator Song, is author of Senate Bill 1500; and <br /> <br /> WHEREAS, Senate Bill 1500 has already received public <br />support of the Administration; and <br /> <br /> WHEREAS, the City Council of the City of Santa Ana finds <br />satisfactory the existing law of the State of California govern- <br />ing the organization of the lower state courts; and <br /> <br /> WHEREAS, Senate Bill 1500, if enacted, would substan- <br />tially alter the present organization of the judiciary in that <br />it: <br /> <br />eliminates municipal courts, creating only a <br />"single trial court" of general jurisidiction <br />for the entire state, <br /> <br />2. removes from the county to the state, the financial <br /> support of the judicial system, and <br /> <br />e <br /> <br />diverts city revenue derived from Vehicle Code <br />fines and forfeitures presently allocated to <br />cities under Section 1463 of the California <br />Penal Code to the state to support the new <br />organization. Such division of city revenues <br />amounts to approximately $30,000,000.00 state- <br />wide, $2,000.000.00 from the other cities of <br />Orange County and $340,000.00 from the City of <br />Santa Ana alone; and <br /> <br /> WHEREAS, the purpose of the present law embodied in Sec- <br />tion 1463 of the California Penal Code as adopted in 1949 was that <br />when the cities gave up control of their own, then existing, city <br />and municipal court system, they would not lose any of the revenue <br />derived therefrom; and <br /> <br /> WHEREAS, Senate Bill 1500, if enacted, would be a sub- <br />stantial detriment to city government: <br /> <br />1. financially through diversion of the afore- <br /> mentioned funds and <br /> <br />2. politically through interference with local govern- <br /> mental policies and spending by indirect methods. <br /> <br /> <br />
