RESOLUTION NO. 7640 <br /> <br />A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA CLOSING <br />MORTIMER STREET AT CIVIC CENTER <br />DRIVE <br /> <br /> WHEREAS, Section 21101 of the Vehicle Code of the State of California <br />authorizes the legislative body having jurisdiction over a city street to <br />close such street to vehicular traffic when in the opinion of the legislative <br />body such street is no longer needed for vehicular traffic; and <br /> <br /> WHEREAS, Mortimer Street is a street within the jurisdiction of the City <br />Council of the City of Santa Ana; and <br /> <br /> WHEREAS, on April 5, 1976 the City Council of the City of Santa Ana held <br />a public hearing on the question of whether Mortimer Street should be closed <br />at the intersection thereof with Civic Center Drive on the south side of Civic <br />Center Drive by construction of a permanent cul-de-sac on Mortimer Street at <br />such location; and <br /> <br /> WHEREAS, at such hearing the Council heard and considered the reports and <br />recommendations of the administrative staff of the City of Santa Ana and the <br />evidence of all persons speaking for or against the proposed closure of Mortimer <br />Street; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa <br />Ana does hereby authorize and approve the construction of a permanent cul-de-sac, <br />such closure to be at its intersection with Civic Center Drive on the south side <br />thereof, such closure to be permanent unless ordered by resolution of this body <br />to be opened. <br /> <br /> BE IT FURTHER RESOLVED: That the Director of Public Works shall erect or <br />cause to be erected appropriate signs giving notice of such street closure. <br /> <br /> BE IT FURTHER RESOLVED: That by this Resolution the City of Santa Ana <br />does not surrender its title or any portion thereof in or to said street, <br /> <br /> BE IT FURTHER RESOLVED: That the Council does hereby adopt the following <br />as its findings of fact upon which is based its determination to close Mortimer <br />Street as described hereinabove: <br /> <br /> 1. That the elimination of through traffic on Mortimer Street between <br />Santa Ana Boulevard and Civic Center Drive produces only minor inconvenience to <br />a limited number of motorists daily. <br /> <br /> 2. That the construction of a cul-de-sac on that portion of Mortimer Street <br />located between Santa Aha Boulevard and Civic Center Drive will eliminate use of <br />Mortimer Street by through traffic and decrease speeds and accidents increasing <br />the safety of the residents and pedestrians crossing the street; <br /> <br /> 3. That adjacent land owners have considered the impact of the cul-de-sac <br />to their property and indicated support for the concept. <br /> <br /> 4. That any property currently having driveway access to the closed <br />segment of Mortimer Street will be provided the same continued access to that <br />driveway. <br /> <br /> 5. That the closure will not have any significant detrimental effect <br />on the furnishing of police, fire and other municipal services to residents <br />on Mortimer Street; <br /> <br /> <br />
