RESOLUTION NO. 76-62 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA, ADOPTED PURSUANT TO <br />THE PROVISIONS OF SECTION 935.4 AND <br />SECTION 949 OF THE GOVERNMENT CODE OF <br />THE STATE OF CALIFORNIA, DELEGATING <br />TO THE CITY MANAGER THE AUTHORITY TO <br />COMPROMISE AND SETTLE CLAIMS AND <br />ACTIONS FOR DAMAGES, SUBJECT TO <br />CERTAIN LIMITATIONS. <br /> <br /> WHEREAS, Section 935.4 of the Government Code of the State <br />of California provides, in pertinent part, that this Council may <br />authorize an employee to allow, compromise or settle claims against <br />the City of Santa Ana, subject to certain limitations; and <br /> <br /> WHEREAS, Section 949 of said Government Code provides that <br />"The governing body of a local public entity may compromise, or may <br />delegate the authority to its attorney or an employee to compromise, <br />any pending action." <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Ana, as follows: <br /> <br /> That the City Manager is hereby authorized to allow, com- <br />promise or settle any claim against the City of Santa Ana, and to <br />compromise any pending action against the City of Santa Ana, pro- <br />vided, however, that no such allowance, compromise or settlement is <br />authorized hereby if it involves payment of more than Two Thousand <br />Five Hundred Dollars ($2,500.00) for any claim or action involving <br />only damage to property, or Five Hundred Dollars ($500.00) in any <br />claim or action involving bodily injury or other personal injury. <br /> <br /> The authorization extended hereby shall be effective from <br />and after July 1, 1976. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its re§ular meeting held on the 19th day of <br />3u1¥ , 1976. <br /> <br />ATTEST: <br /> <br />~ ~FLORENCE I.
