Recorded August 20, 1976 <br />9:05 a.m. <br />Book 11859 Page 892 <br /> <br />RESOLUTION NO. 76~02 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA VACATING MARTHA LANE WEST OF <br />PACIFIC AVENUE IN THE CITY OF SANTA ANA <br /> <br /> WHEREAS, this Council heretofore adopted, on July 19, <br />1976, a resolution No. 76-73, wherein it declared its intention <br />to vacate pursuant to and in accordance with the provisions of <br />Part 3 of Division 9 of the Streets and Highways Code of the <br />State of California, Martha Lane west of Pacific Avenue, said <br />portion of said street being specifically described in said reso- <br />lution and reference being made in said resolution to a certain <br />map on file in the office of the Clerk of the Council for full <br />particulars as to such proposed vacation; and <br /> <br /> WHEREAS, said resolution gave notice that on Monday, <br />the 16th day of August, 1976, at 7:30 p.m., or as soon thereafter <br />as the matter can be heard, in the Council chambers of the City <br />of Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this <br />Council would hear any and all persons interested in or objecting <br />to said proposed vacation of said Martha Lane west of Pacific <br />Avenue; and <br /> <br /> WHEREAS, this Council finds that said resolution has <br />been published in the manner prescribed by law for the publishing <br />of ordinances of the City; and <br /> <br /> WHEREAS, this Council further finds that notices of <br />said proposed street vacation stating the purpose of said resolu- <br />tion and the time and place set for hearing, were posted as directed <br />by the Council and required by law; and <br /> <br /> WHEREAS, this Council, at the time and place set for <br />hearing, has heard any and all persons interested in or objecting <br />to said proposed vacation of said portion of said street, and has <br />received and considered all evidence submitted; and <br /> <br /> WHEREAS, this Council finds, from all the evidence sub- <br />mitted, that the following portion of the following street, des- <br />cribed in the above mentioned resolution, is unnecessary for pre- <br />sent or prospective public street purposes; and <br /> <br /> WHEREAS, pursuant to the provisions of Section 2381 of <br />Chapter 8 of Division 3 of the Streets and Highways Code of the <br />State of California, this Council does hereby find and determine <br />that neither said portion of said street nor parts thereof is use- <br />ful as bicycle paths or routes; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Ana that the following portion of Martha Lane west of <br />Pacific Avenue in the City of Santa Ana, be and is hereby vacated: <br /> <br />Ail of Martha Lane as shown in a map of Tract 1292, <br />recorded in the office of the Recorder of Orange <br />County in Book 46 of Miscellaneous Maps, page 5, <br />and all of Martha Lane as shown in a map of Tract <br />758 recorded in the office of said Recorder in Book <br />23 of Miscellaneous Maps, page 26, west of a line <br />35' Westerly and parallel to the centerline of <br />Pacific Avenue as shown on said map of Tract 758. <br /> <br /> The City Clerk is hereby directed to cause a certified <br />copy hereof, attested by her under seal, to be recorded forthwith <br />in the Office 6f the Recorder of Orange County. <br /> <br /> <br />
