EXHIBIT "A" <br /> <br />Together with the perpetual right and easement to discharge <br />and conduct storm and surface drainage waters through said <br />facilities, and to use and occupy said real property for <br />said purposes. <br /> <br />Together with the perpetual right to remove any and all <br />trees and surface growth and debris within the above described <br />real property; Together with the further right of the City <br />of Santa Ana, its agents or representatives to enter upon and <br />use a temporary construction area 20 feet in width along the <br />entire length adjacent to the southerly side of said easement <br />for the period of 1 year from the date the Order of Possession <br />becomes effective for the proper and efficient excavation <br />and use of earth, materials, supplies or equipment during the <br />initial construction of said line or lines within the herein- <br />above described perpetual easement area. <br /> <br />Grantor hereby covenants and agrees on behalf of himself, his <br />heirs, successors, and assigns, that neither he, nor any of <br />them, shall construct or permit to be constructed any building <br />or permanent structure within the real property described in <br />the above paragraph, or make any permanent excavation, or <br />permit any permanent excavation to be made within the above <br />described real property. <br /> <br />The City of Santa Ana agrees to indemnify and hold the grantor <br />harmless from any liability arising out of the City's use of <br />said perpetual easement and temporary construction areas; and <br />further agrees, at its sole cost and exp6nse, to restore said <br />property as nearly as practicable to its former state and <br />condition upon completion of said construction, installation, <br />maintenance and repair operations. <br /> <br />EXHIBIT A OF EXHiBiT "B" <br /> <br /> <br />
