Book 12048 - Page 359 <br />January 26, 1977 <br />11:05 a.m. <br /> <br />CTD:rs <br />1-12-77 <br /> <br />RESOLUTION NO. 77-12 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA VACATING A PORTION OF SECOND STREET <br />AND THE D~LEYS ~N BLOCKS 6 and 7 OF THE "DAWSON <br />AND CUMMINGS ADDITION TO THE TOWN OF SANTA ANA" <br />BETWEEN LOWE STREET (VAN NESS AVENUE) AND ROSS <br />STREET AND A PORTION OF THE EAST HALF OF LOWE <br />STREET (VAN NESS AVENUE) BETWEEN FIRST AND THIRD <br />STREETS IN THE CITY OF SANTA ANA, CALIFORNIA. <br /> <br /> BE IT RESOLVED by the City Council of the City of Santa <br />Ana: <br /> <br /> WHEREAS, this Council heretofore adopted on December 20, <br />1976, a Resolution No. 76-149, wherein it declared its intention <br />to vacate pursuant to and in accordance with the provisions of <br />Part 3 of Division 9 of the Streets and Highways Code of the <br />State of California, a portion of Second Street and the alleys <br />in blocks 6 and 7 of the "Dawson and Cummings Addition To The <br />Town of Santa Ana" between Lowe Street (Van Ness Avenue) and <br />Ross Street and a portion of the East half of Lowe Street (Van <br />Ness Avenue) between First and Third Streets, said portions of <br />said streets and alleys being specifically described in said <br />Resolution and reference being made in said Resolution to a <br />certain Map on file in the office of the Clerk of the Council <br />for full particulars as to such proposed vacation; and <br /> <br /> WHEREAS, said Resolution gave notice that on the 17th day <br />of January, 1977, at 7:30 P.M., or as soon thereafter as the <br />matter can be heard, in the Council Chambers of the City of <br />Santa Ana, 20 Civic Center Plaza, Santa Ana, California, this <br />Council would hear any and all persons interested in or object- <br />ing to said proposed vacation of the said portions of Second <br />Street and the alleys in blocks 6 and 7 of the "Dawson and <br />Cummings Addition To The Town of Santa Ana" and said portion <br />of the East half of Lowe Street; and <br /> <br /> WHEREAS, this Council finds that said Resolution has been <br />published in the manner prescribed by law for the publishing of <br />ordinances of the City; and <br /> <br /> WHEREAS, this Council further finds that notices of said <br />proposed street vacations stating the purpose of said Resolution <br />and time and place set for hearing, were posted as directed by <br />the Council and required by law; and <br /> <br /> WHEREAS, this Council at the time and place set for hearing <br />has heard any and all persons interested in or objecting to said <br />proposed vacation of said portions of said streets and alleys, <br />and has received and considered all evidence submitted; and <br /> <br /> WHEREAS, this Council finds from all the evidence submitted <br />that the said portions of the said streets and alleys described <br />in the above mentioned Resolution, and described more fully in <br />"Exhibit A" attached hereto, are unnecessary for present or pros- <br />pective street purposes based upon the following findings of fact: <br /> <br /> 1. The proposed vacation would eliminate traffic hazards <br />by eliminating three internal intersections as well as eliminating <br />access from driveways and parking areas onto the heavily traveled <br />First and Third Streets. <br /> <br /> <br />
