RCS:lm <br />6/22/77 <br /> <br />RESOLUTION NO. 77-66 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA REVERSING THE ACTION OF THE <br />PLANNING COMMISSION ON VARIANCE APPLICATION <br />77-11 AND APPROVING SAID VARIANCE APPLICATION <br />AND APPEAL NO. 376. <br /> <br /> W}~REAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on June 20, 1977, on the <br />action taken by the Planning Commission in denying Variance <br />Application No. 77-11, which application seeks to allow self- <br />service gas pumps on an existing market site in the C-5 <br />District, and <br /> <br /> WHEREAS, the Planning Cox~ission denied such applica- <br />tion on April 11, 1977, and <br /> <br /> WHEREAS, prior to taking action on said Variance <br />Application, this Council has reviewed and considered the nega- <br />tive declaration for the project; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Santa Ana as follows: <br /> <br /> 1. That based on such public hearing and oral and <br />documentary evidence submitted therein, the City Council does <br />hereby reverse the action of the Planning Commission denying <br />said Variance Application 77-11 and does hereby approve said <br />Variance Application and grants Appeal No. 376. <br /> <br /> 2. That the City Council approves the findings con- <br />tained in the negative declaration and finds that the project <br />will not have a significant effect upon the environment. <br /> <br /> 3. That the City Council adopts as its findings of <br />fact for approval of Variance Application No. 77-11 the Findings <br />of Fact, Variance Application No. 77-11, prepared and submitted <br />by the Planning Commission, on file with the Clerk of the Council <br />and incorporated herein as though fully set forth, except as the <br />same are inconsistent with the action herein taken in approving <br />said Variance, and approyes said Variance Application subject <br />to the conditions set forth therein.
