RCS:lm <br />7-27-77 <br /> <br />RESOLUTION NO. 77~$1 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AFFIRMING THE DECISION OF THE <br />PLANNING COMMISSION ON CONDITIONAL USE PER- <br />MIT NO. 77-8 AND APPROVING SAID CONDITIONAL <br />USE PERMIT. <br /> <br /> WHEREAS, a public hearing was duly held before the <br />City Council of the City of Santa Ana on July 18, 1977, on <br />the action taken by the Planning Commission in approving <br />Conditional Use Permit No. 77-8; and <br /> <br /> WHEREAS, prior to taking action on said Variance <br />Application this Council has reviewed and considered the in- <br />formation contained in Negative Declaration No. 77-89 for the <br />subject property and, on the basis thereof, finds that the <br />project will not have a significant effect upon the environ- <br />ment, <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. That based on such public hearing and the oral <br />and documentary evidence submitted therein, the City Council <br />does hereby affirm the action of the Planning Commission on <br />Conditional Use Permit No. 77-8 and does hereby approve said <br />Conditional Use Permit. <br /> <br /> 2. That the City Council hereby adopts as its find- <br />ings of fact for approval of the Negative Declaration and Con- <br />ditional Use Permit No. 77-8 that certain "Finding of Fact, <br />Conditional Use Permit No. 77-8," prepared and submitted by <br />the Planning Commission, on file in the office of the Clerk of <br />the Council and incorporated by reference herein as though <br />fully set forth. <br /> <br /> 3. That the City Council approves said Conditional <br />Use Permit No. 77-8 subject to the conditions and requirements <br />set forth in the "Finding of Fact, Conditional Use Permit <br />No. 77-8," and subject to the additional conditions that <br />(a) parking be provided as required under Conditional Use Per- <br />mit No. 71-19, and (b) that this Conditional Use Permit is <br />granted for a term of one year from the date of this approval, <br />at which time this Conditional Use Permit shall terminate; <br />however, the Planning Commission may annually grant extensions <br />of one year each under the same or different conditions (how- <br />ever, no less restrictive) without the necessity of filing an <br />additional application, in the event that the Planning Com- <br />mission determines each time that the conditions of the Con- <br />ditional Use Permit have been met and that the property con- <br />tinues to meet the standards for granting a Conditional Use <br />Permit. Any additional extensions of this Conditional Use Per- <br />mit, however, shall be subject to such annual review and subject <br />to approval by the City Council in the same manner as any Con- <br />ditional Use Permit. <br /> <br /> ADOPTED this lst day of August , 1977, by the <br />following vote: <br /> <br /> <br />
