RESOLUTION NO. 77-132 <br /> <br />RESOLUTION OF THE CITY COUNCIL OVERRULING <br />AND DENYING PROTESTS AND MAKING CERTAIN <br />FINDINGS. <br /> <br />CITY OF SANTA ANA <br /> <br /> WHEREAS, this City Council has held and conducted a <br />Public Hearing on the confirmation of the assessments and acceptance <br />of the works of improvements in a special assessment district with <br />the terms and proceedings being conducted pursuant to the provisions <br />of the "Improvement Act of 1911", being Division 7 of the Streets <br />and Highways Code of the State of Califgrnia; said specia! assess- <br />ment district known and designated as <br /> <br />ASSESSMENT DISTRICT NO. 240 <br /> <br />(hereinafter referred to as the "Assessment District"); and, <br /> <br /> VYHEREAS, certain owners of property liable to be assessed <br />for certain works of improvements have filed written protests or <br />objections and delivered the same to the City Clerk not later than <br />the hour set for the hearing thereon and said protests have been <br />presented to the City Council for their consideration and this <br />Council has proceeded to hear the same and is now ready to proceed <br />with the confirmation of the assessments and acceptance of the <br />works of improvements. <br /> <br />OF THE <br /> <br />NOW. <br /> <br />THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL <br /> CITY OF SANTA ANA <br /> <br />CALIFORNIA, AS FOLLOWg: <br /> <br />SECTION 1. That the above recitals are all true and <br /> <br />correct. <br /> <br /> SECTION 2. That all protests and objections of every <br />kind and nature be, and the same hereby are, overruled and denied. <br /> <br /> SECTION 3. That it is hereby further determined that <br />all properties within the boundaries of the Assessment District do <br />receive a local and direct benefit from the works of improvements <br />and that the assessable costs and expenses have been apportioned <br />and spread against the properties within the Assessment District <br />in direct proportion to benefits received thereto. <br /> <br /> SECTION 4. That the Engineer's method and formula of <br />assessment spread is equitable and hereby approved by this City <br />Council as being a correct and proper apportionment and distri- <br />bution of all assessable costs in relation to the benefits re- <br />ceived from the works of improvements constructed under these <br />proceedings. <br /> <br /> <br />
