RESOLUTION NO. 77-134 <br /> <br />RESOLUTION OF THE CITY COUNCIL CONFIRMING <br />ASSESSMENT PURSUANT TO "IMPROVEMENT ACT <br />OF 1911", BEING DIVISION 7 OF THE STREETS <br />AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA <br /> <br />CITY OF SANTA ANA <br /> <br /> WHEREAS, there has been filed with the City Clerk an assess- <br />ment to represent the costs and expenses of the work and improvements <br />done pursuant to proceedings had and taken under the provisions of the <br />"Improvement Act of 1911", being Division 7 of the Streets and High- <br />ways Code of the State of California, and pursuant to Resolution of <br />Intention No. 76-54 , all within the boundaries of a special assess- <br />ment district know~ and designated as <br /> <br />ASSESSMENT DISTRICT NO. 240 <br /> <br />(hereinafter referred to as the "Assessment District"); and, <br /> <br /> WHEREAS, <br />provided by law of <br />for hearing; and, <br /> <br />the City Clerk has duly given notice in the manner <br />the filing of said assessment and of the time set <br /> <br /> WHEREAS, said City Council is now satisfied as to the proper <br />completion of the work and of the spreading of the assessment. <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL <br /> <br />OF THE <br /> <br />CITY OF SANTA ANA <br /> <br />CAI~IFORNIA, AS FOLLOWS: <br /> <br />SECTION 1. That the above recitals are all true and correct. <br /> <br /> SECTION 2. That the assessment and diagram, the proceedings <br />leading up to the same, and all acts and determinations of the officers <br />and agents of said City in re.lation to the work done and appurtenances <br />and appurtenant in said Assessment District and to the said assessment, <br />and the diagram attached thereto, be, and the same are hereby ratified <br />and confirmed, the work and improvement is accepted, and the Superin- <br />tendent of Streets is hereby ordered and directed to attach to said <br />assessment a warrant in the manner and form provided by law,' said <br />warrant bearing date of this Resolution, and is further ordered to <br />deliver said warrant, diagram and assessment to the contractor, or its <br />assignee, as the case may be, forthwith upon payment of the incidental <br />expenses due thereon. <br /> <br /> SECTION 3. That the assessment roll, warrant and diagram <br />shall be recorded in the Office of the Superintendent of Streets and <br />immediately thereafter the City Clerk shall file a copy of the assess <br />ment diagram in the Office of the County Recorder, and thereafter shall <br />record in said Office of the County Recorder a Notice of Assessment, <br />all in the manner and form as prescribed by Section 3114 of the Streets <br />and Highways Code of the State of California. <br /> <br /> <br />
