RESOLUTION NO. 77-134 RESOLUTION OF THE CITY COUNCIL CONFIRMING ASSESSMENT PURSUANT TO "IMPROVEMENT ACT OF 1911", BEING DIVISION 7 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA CITY OF SANTA ANA WHEREAS, there has been filed with the City Clerk an assess- ment to represent the costs and expenses of the work and improvements done pursuant to proceedings had and taken under the provisions of the "Improvement Act of 1911", being Division 7 of the Streets and High- ways Code of the State of California, and pursuant to Resolution of Intention No. 76-54 , all within the boundaries of a special assess- ment district know~ and designated as ASSESSMENT DISTRICT NO. 240 (hereinafter referred to as the "Assessment District"); and, WHEREAS, provided by law of for hearing; and, the City Clerk has duly given notice in the manner the filing of said assessment and of the time set WHEREAS, said City Council is now satisfied as to the proper completion of the work and of the spreading of the assessment. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA CAI~IFORNIA, AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the assessment and diagram, the proceedings leading up to the same, and all acts and determinations of the officers and agents of said City in re.lation to the work done and appurtenances and appurtenant in said Assessment District and to the said assessment, and the diagram attached thereto, be, and the same are hereby ratified and confirmed, the work and improvement is accepted, and the Superin- tendent of Streets is hereby ordered and directed to attach to said assessment a warrant in the manner and form provided by law,' said warrant bearing date of this Resolution, and is further ordered to deliver said warrant, diagram and assessment to the contractor, or its assignee, as the case may be, forthwith upon payment of the incidental expenses due thereon. SECTION 3. That the assessment roll, warrant and diagram shall be recorded in the Office of the Superintendent of Streets and immediately thereafter the City Clerk shall file a copy of the assess ment diagram in the Office of the County Recorder, and thereafter shall record in said Office of the County Recorder a Notice of Assessment, all in the manner and form as prescribed by Section 3114 of the Streets and Highways Code of the State of California.
