WHEREAS, RESOLUTION NO. 78-31 'RESOLUTION OF THE CITY COUNCIL AWARDING CONTRACT FOR CONSTRUCTION OF CERTAIN PUB- LIC WORKS OF IMPROVEMENT TOGETHER WITH APPURTENANCES IN SPECIAL ASSESSMENT DISTRICT. CITY OF SANTA ANA sealed bids have been publicly opened, examined and declared for the doin~ of the work and improvements described in Resolution of Intention No. 78-16' , which Resolution of Intention is hereby ex- pressly referred to for a description of said work and improvements and for all other particulars relative to the proceedings under said Resolution of Intention, in a special assessment district known as ASSESSMENT DISTRICT NO. 241 (hereinafter referred to as the "Assessment District"). NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY CouNCIL OF THE CITY OF SANTA ANA CALIFOrnIA, AS FOLLOWS: SECTION 1. That the City Council of said City hereby rejects all of said sealed proposals or sealed bids except that herein mentioned, and hereby awards the contract for doing said work and making said improvements in said Assessment District to the lowest responsible bidder, to-wit: Sully-Miller Contracting Company at the prices named in the bid of said bidder on file in the Office of the City Clerk of said City. SECTION 2. The City Clerk is hereby directed to publish Notice of said award in THE REGISTER ' , a newspaper published and of general circulation in said City, said Notice to be published twice by two (2) separate consecutive insertions in said newspaper. SECTION 3. The Contractor, upon execution of the contract, shall furnish bonds for labor, material and faithful perfor- mance in the amounts as set forth in the specifications as previously approved for this Assessment District. SECTION 4. That it has further been determined by the City Council that the public interest will not be served by allowing the property owners to take the contract for the work or improvements to be done under these proceedings. SECTION 5. That the Contractor shall execute the contract in the times and manner as set forth in the "Improvement Act of 1911", being Division 7 of the Streets and Highways Code of the State of California.
